How to deal with crimes committed by foreigners in China and China?

1. Arrest is divided into two cases: cases in which foreigners and stateless persons are suspected of endangering national security, cases involving political and diplomatic relations between countries, and cases in which the application of the law is indeed difficult. If it is necessary to arrest a criminal suspect, the people's procuratorate at or below the prefecture level shall review and put forward opinions and report them to the Supreme People's Procuratorate for review. After consulting the Ministry of Foreign Affairs, the Supreme People's Procuratorate decided to approve the arrest. If it is considered unnecessary to arrest after examination, a decision not to approve the arrest may be made directly.

2. Cases in which foreigners and stateless persons are suspected of crimes other than those mentioned above shall be examined by branch, state and municipal people's procuratorates and submitted to provincial people's procuratorates for examination. After consulting the foreign affairs department of the government at the same level, the Provincial People's Procuratorate decided to approve the arrest and reported it to the Supreme People's Procuratorate for the record. If it is considered unnecessary to arrest after examination, a decision not to approve the arrest may be made directly.

3. With regard to defense, if the defendant of foreign nationality entrusts a lawyer to defend, and if the plaintiff or private prosecutor entrusts a lawyer to represent the lawsuit, he shall entrust a lawyer who is qualified as a lawyer in People's Republic of China (PRC) and has obtained a practice certificate according to law.

4. If the defendant of foreign nationality has not entrusted a defender, the people's court may appoint a defender for him. If the defendant refuses the defender to defend him, he shall submit a written statement or record his oral statement at the end of the volume, and the people's court shall allow it.

5. Regarding the criminal responsibility of foreigners, if foreigners commit crimes and should be investigated for criminal responsibility, the provisions of this Law shall apply. If a foreigner who enjoys diplomatic privileges and immunities commits a crime and should be investigated for criminal responsibility, it shall be resolved through diplomatic channels.
