Article 44 of the Criminal Procedure Law of People's Republic of China (PRC): A defender or any other person shall not help a criminal suspect or defendant to conceal, destroy, forge evidence or collude with others, and shall not threaten or induce witnesses to commit perjury or engage in other acts that hinder judicial proceedings.

Anyone who violates the provisions of the preceding paragraph shall be investigated for legal responsibility according to law. If a defender is suspected of committing a crime, it shall be handled by an investigation organ other than the investigation organ where the defender undertakes the case. If the defender is a lawyer, he shall promptly notify the law firm where he belongs or the lawyers association to which he belongs.

According to Article 38 of the Criminal Procedure Law of People's Republic of China (PRC), what lawyers can do in the investigation stage:

1. Provide legal advice to criminal suspects to help them understand relevant laws and regulations. Lawyers providing legal advice to criminal suspects cannot be understood as merely reading out the legal provisions or explaining the legal provisions themselves, nor can they be understood as merely answering legal questions raised by criminal suspects. Lawyers have the responsibility to provide assistance to criminal suspects at any time, such as informing them of their due litigation rights and related legal responsibilities. ?

2. Acting as an agent for criminal suspects to appeal and accuse, and acting as an agent for criminal suspects to defend themselves to relevant departments, complain grievances and accuse investigators, etc. Any accusation or accusation made by a lawyer must be approved by the criminal suspect. If a criminal suspect is unable to appeal or accuse because of serious illness or other special reasons, or is afraid to appeal or accuse because of threats, a lawyer may appeal or accuse the criminal suspect on his own initiative.
