The Intermediate People's Court is a first-level people's court and a level of the people's court system. Its superior unit is the High People's Court, which is located in prefecture-level administrative regions except Taiwan Province, Hong Kong and Macao Special Administrative Regions ( Including prefecture-level cities, autonomous regions, regions, leagues) and the people's courts of municipalities directly under the Central Government.
The Intermediate People's Court is responsible for hearing first-instance cases that are under its jurisdiction according to laws and decrees, first-instance cases transferred to it by the Basic People's Court for trial, and third-instance appeals or protests against the judgments and rulings of the Basic People's Court. Second-instance cases are cases in which the People's Procuratorate files a protest in accordance with the trial supervision procedures.
The Intermediate People's Court hears the following cases:
1. First-instance cases that are under the jurisdiction of the Intermediate People's Court according to laws and regulations;
2. Basic People's Courts Transferred first-instance cases;
3. Appeals and protest cases against the judgments and rulings of basic people's courts;
4. Protest cases filed by the People's Procuratorate in accordance with trial supervision procedures. Protest cases.

Article 231
Defendant, private prosecution If the plaintiff or defendant in an incidental civil action files an appeal through the people's court of first instance, the people's court of first instance shall transfer the appeal petition, files, and evidence to the people's court at the next higher level within three days.
If the defendant, private prosecutor, plaintiff or defendant in an attached civil lawsuit directly appeals to the People's Court of second instance, the People's Court of second instance shall transfer the appeal to the People's Court of first instance within three days. The People's Procuratorate at the same level as the court and the other party.
