Reflections on Reading The Appeal of Justice

The Pursuit of Justice: A Comparison between Simpson Case and Du Case in China, published by Peking University Publishing House, is written by/Zeng Yuexing. This book is a comparison between Chinese and American judicial systems and defense systems. In this book, the famous Simpson case in the United States and the Du case in China are analyzed under the same microscope, aiming to draw out the differences of beautification and the resulting differences in the powers of police, judges and prosecutors. Finally, the true meaning of justice and people's pursuit of justice under different systems are discussed.

Simpson case: Simpson, a famous American football star, was accused of murder. The victim was his ex-wife Nicole, who was also his ex-wife's lover. After being accused of murder, Simpson immediately asked his lawyer to represent all litigation matters, and hired a team of star lawyers known as the "dream team" to defend him. The lawsuit followed strict and meticulous procedures and a strict evidence system, and Simpson was finally acquitted. In fact, the key to Simpson's innocence lies in following the principle of procedural justice in the American judicial system and the effectiveness of excluding illegally obtained evidence in criminal cases, that is, the famous "fruit of poisonous trees" rule.

Du case: Du is a policeman of Kunming Public Security Bureau, suspected of killing his wife and lover. During the whole investigation, Du was tortured by the relevant case handlers to extract confessions, and finally had to admit his "criminal facts". When the real murderer was found, Du Wu Pei had been tortured in prison for 26 months and was exhausted. Of course, this situation is definitely not limited to this. Zhao Zuohai case and She Xianglin case are unjust, false and misjudged cases caused by ignoring procedural justice. China has long neglected procedural justice and failed to correctly understand the true value and significance of litigation, which is an important reason for this kind of misjudged case.

Through the introduction of the above two cases, we can see that the pursuit of procedural justice and result justice in the legal spirit of the two countries is completely different, which is reflected in the pursuit of procedural justice and substantive justice in criminal proceedings. Although this is likely to lead to emotional unacceptable consequences such as "misplacing a thousand, not wronging one", the unjust, false and wrong cases brought about by extorting a confession by torture are extremely shocking. Although some political parties are waiting to solve their grievances, they are late in justice and injustice.

Judging from the new criminal procedure law and the evidence regulations for handling death penalty cases, China's rule of law system is in the stage of slow improvement and rapid catch-up, and the people's pursuit of justice will be effectively guaranteed!
