Article 1 In order to protect the living environment of the city and ensure the safety of the state, collective property and citizens' personal property, these Provisions are formulated in accordance with the relevant laws and regulations of the state and combined with the actual situation of this Municipality.
Article 2 These Provisions shall be implemented by people's governments at all levels. Taiyuan Municipal Public Security Bureau is the competent authority for the implementation of these Provisions.
Industry and commerce administration, environmental protection, city appearance and sanitation, supply and marketing departments, neighborhood offices, residents' committees and villagers' committees shall assist the public security organs in implementing these Provisions.
Article 3 No unit or individual may set off fireworks and firecrackers within the following administrative areas of this Municipality:
Yingze district (except Mengjiajing Township); Xinghualing District (except Xiao Hui's hometown); Wanbailin District (except Wangfeng Township and Huaketou Township); Xiaodian district (except Xiwenzhuang Township, Liu Jiabao Township and Beige Town); Jiancaoping district (except Xiyan Township, Matou Water Town, Baiban Township and Yangqu Town); Jinyuan District (except Yaocun Town, Jinyuan Town and Jinci Town).
Article 4 No unit or individual may retail fireworks and firecrackers in areas where fireworks and firecrackers are prohibited (hereinafter referred to as prohibited areas).
Units engaged in the production and operation of wholesale fireworks and firecrackers shall not sell fireworks and firecrackers wholesale in the forbidden area.
Fifth without the approval of Taiyuan Municipal Public Security Bureau, no unit or individual may transport fireworks into the forbidden area.
Sixth in violation of the provisions of any of the following acts, shall be punished by the public security organs:
(a) the unit that set off fireworks and firecrackers shall be fined between 5,000 yuan and 20,000 yuan, and the person directly responsible and the approver shall be fined between 500 yuan and Kloc-0 and 500 yuan respectively.
(two) individuals who set off fireworks and firecrackers shall be fined between two hundred yuan and five hundred yuan.
(three) individual retail fireworks, fireworks and illegal income confiscated, and impose a fine of more than five hundred yuan and one thousand five hundred yuan; If a unit retails fireworks and firecrackers, the fireworks and firecrackers and illegal income shall be confiscated, and a fine of more than 5,000 yuan and less than 20,000 yuan shall be imposed. The person directly responsible shall also be fined more than 500 yuan 1500 yuan.
(four) without the approval of the import of fireworks, fireworks confiscated, and impose a fine of more than 2000 yuan in 500 yuan on the responsible person.
Article 7 Whoever violates the second paragraph of Article 4 shall be fined 1 10,000 yuan but not more than 50,000 yuan, and the Safety Permit for Explosives or the Sales Permit for Explosives shall be revoked.
Article 8 Anyone who violates Articles 3, 4 and 5 of these Provisions and causes economic losses or personal injury shall be liable for compensation. If a crime is constituted, criminal responsibility shall be investigated according to law.
Article 9 If a person without capacity violates these regulations and a person with limited capacity violates these regulations and has no economic income, his guardian shall be liable for damages.
Article 10 If a party refuses to accept the punishment of the public security organ, he may, within five days from the date of receiving the notice of punishment, apply for reconsideration to the public security organ at the next higher level that made the decision on punishment. The public security organ at the next higher level shall make a ruling within five days after receiving the application for reconsideration. Anyone who refuses to accept the decision of the public security organ at the next higher level may bring a lawsuit to the people's court within five days after receiving the notice of the decision.
If the person being punished fails to apply for reconsideration, bring a lawsuit to the people's court or perform the punishment decision within the time limit, the public security organ may apply to the people's court for compulsory execution.
Eleventh fireworks can be set off in the forbidden area during the Spring Festival, which will be announced by the Taiyuan Municipal People's Government.
If it is necessary to set off fireworks and firecrackers at major national events and festivals, the Taiyuan Municipal People's Government will issue an announcement.
The announcement shall specify the specific time, place and variety of discharge.
Twelfth in violation of the provisions of the discharge, sale and import of fireworks, units and citizens can discourage and report; The people's government shall commend or reward those who report meritorious service.
Thirteenth problems in the specific application of these Provisions shall be interpreted by the Taiyuan Municipal People's Government.
