What is the alarm filing process?

Alarm submission process:

1. Bring your ID card and relevant clue materials when reporting the case.

2. Under normal circumstances, the police either ask the informant to write the report materials or make an inquiry record for the informant. The comrades in the police station will register the report and accept the evidence materials.

3. After receiving the alarm information, the public security organ shall issue a report receipt according to law.

4. When calling the police, the informant should provide relevant information truthfully so that the police can correctly judge the case. As for the nature of the case, it is up to the police station to file an investigation.

5. According to the Procedures of Public Security Organs for Handling Criminal Cases, if the complainant decides not to file a case, the public security organ shall make a Notice of Not Filing a Case and serve it on the complainant within three days.

6. If the complainant refuses to accept the decision not to file a case, he may apply for reconsideration.

7. The public security organ shall promptly review the report materials, and if it believes that there are criminal facts that need to be investigated for criminal responsibility, it shall file a case; If it is considered that there is no criminal fact, or the criminal fact is obviously minor, it is not necessary to pursue criminal responsibility, and the case will not be filed.

Article 109 of the Criminal Procedure Law of People's Republic of China (PRC), when a public security organ or a people's procuratorate discovers a criminal fact or a criminal suspect, it shall file a case for investigation within its jurisdiction.

Article 110 Any unit or individual who discovers criminal facts or suspects has the right and obligation to report to the public security organ, the people's procuratorate or the people's court.

Victims have the right to report and accuse criminal facts or criminal suspects who infringe their personal and property rights to public security organs, people's procuratorates or people's courts.

Public security organs, people's procuratorates or people's courts shall accept reports, complaints and reports. If it does not belong to its own jurisdiction, it shall be transferred to the competent authority for handling, and the informant, complainant and informant shall be notified; For those who are not under their jurisdiction and must take emergency measures, they should take emergency measures first and then transfer them to the competent department.

Where a criminal surrenders himself to a public security organ, a people's procuratorate or a people's court, the provisions of the third paragraph shall apply.
