Whether the police station can file a fight against underage children depends on the situation:

1. If a minor is dissatisfied with 16 years old and fights, criminal cases will generally not be filed;

2. Minors who fight and fight are ringleaders or active participants, and if the circumstances are serious, they should be placed on file for the crime of stirring up trouble.

Minors under the age of 14 are still in infancy, lack of social knowledge, and have no ability to foresee the consequences of their actions and take responsibility. For these minors who violate the administration of public security, education should be given priority, so that they can distinguish right from wrong and no longer be punished, which is more conducive to their growth. However, not punishing them does not mean leaving them alone. Their guardians should be ordered to strictly discipline them to prevent them from continuing to endanger society. For minors who have reached the age of 14 but are under the age of 18, considering that they have certain control and discrimination ability, but their thoughts are not fully mature, they should be given a lighter or mitigated punishment.

Whoever gathers people to fight shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance; Under any of the following circumstances, the ringleaders and other active participants shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years:

(a) repeatedly affray;

(2) affrays are large in number and scale and have a bad social impact;

(three) in public places or traffic arteries, causing serious social disorder;

(4) Armed affrays.

Crime of intentional injury; Whoever affrays for the crime of intentional homicide, causing serious injury or death, shall be convicted and punished in accordance with the provisions of Articles 234 and 232 of this Law.
