A criminal litigation agent refers to a person who, within the authority of the agent, carries out litigation activities on behalf of the agent. In our country, except for cases where the law stipulates that the parties must litigate in person, victims in criminal proceedings, private prosecutors, plaintiffs, defendants, and third parties in civil proceedings can all be represented by criminal litigation agents. The legal representative's participation in criminal proceedings is based on the provisions of the law, not on the basis of a client relationship. Therefore, in criminal proceedings, the legal agent has an independent legal status and is not bound by the will of the client. The client's consent is not required when exercising agency power. The duty of a legal agent to participate in criminal proceedings is to protect the personal rights, property rights, litigation rights and all other legal rights of persons with incapacity or with limited capacity in accordance with the law; at the same time, the legal agent has the responsibility to supervise the behavior of the agent. The legal representative enjoys extensive litigation rights equal to those of the client. However, the legal representative cannot make statements on behalf of the client, nor can he assume obligations related to personal freedom on behalf of the client.
