If it constitutes a criminal case, can the victim close the case after the two sides settle privately?

If it constitutes a criminal case, it can only be a part of civil compensation, and the criminal responsibility cannot be settled, and the victim cannot close the case.

Article 107 of the Criminal Procedure Law stipulates that when a public security organ or a people's procuratorate discovers a criminal fact or a criminal suspect, it shall file a case for investigation within its jurisdiction.

Reconciliation of criminal cases can be divided into reconciliation within the judicial system and reconciliation outside the judicial system. Privatization in the judicial system refers to the criminal reconciliation practice adopted by judicial organs in various places in China's legislation and judicial practice. Criminal reconciliation focuses on repairing damaged social relations and is in line with the development trend of international criminal justice. Personal settlement outside the judicial system can be divided into legal settlement and illegal settlement. If the victim of private prosecution chooses not to sue for settlement, it is called legal settlement.

Legal reconciliation comes from the provisions of China's criminal law and criminal procedure law on private prosecution cases. Cases of private prosecution include the following situations: cases handled after notification in the specific provisions of criminal law include the following charges: 1, insult and slander; 2. The crime of violent interference with freedom of marriage (except those that cause death); 3. Crime of abuse and embezzlement (except those that cause serious injury or death); 4. Minor criminal cases that the victim has evidence to prove, including intentional injury (minor injury), illegal invasion of residence, infringement of freedom of communication, bigamy, abandonment, infringement of intellectual property rights, production and sale of fake and inferior products (except those that seriously endanger social interests and national interests), and infringement of citizens' personal, democratic and property rights, can be sentenced to a penalty of not more than three years.
