(five) other tasks related to archival work assigned by the leadership. Article 5 People's courts at all levels shall strengthen the construction of archives cadres. In accordance with the requirements of revolutionization, youthfulness, knowledge and specialization, we should equip archivists for professional training, and educate archivists to love their jobs and remain relatively stable. Article 6 The archival work of local people's courts shall be subject to the guidance, supervision and inspection of the local archival business management organs at the same level.
Two. Receiving and sorting of archives Article 7 Archives and offices shall actively organize the filing of litigation files. Keep abreast of the filing of cases, and urge the filing contractor to file in time. When receiving the files, it is necessary to check them clearly one by one, and check the quality of the files according to the requirements set forth in the Measures for Filing and Filing Litigation Documents of People's Courts. Those that meet the requirements shall be accepted. Eighth of the received files, according to the criminal, civil and economic categories, according to the year, trial level, case number, respectively, into the file directory. Registration should be accurate and the font should be neat. Ninth received files should be stamped with the "archived" seal in the upper left corner of the volume to distinguish them from the unfilled files. Article 10 Archived files shall be arranged according to criminal, civil and economic categories, in order of year, trial level and case number, and put into filing cabinets for safekeeping. Twelfth people's courts at all levels shall, according to the archives, compile the index of case names, cards and other retrieval tools.
Three. Borrowing and consulting files Article 13 The case undertaker of the trial court of our hospital may borrow the files filed by his own unit because of the need of handling cases, unless it is expressly stipulated that it must be approved by the leaders. Non-filing units should have certain approval procedures for consulting litigation files due to work needs. Article 14 The people's court at a higher level and the public security and procuratorial organs at the same level shall, according to the official letter of transfer, go through the borrowing procedures with the approval of the competent leader and stipulate the borrowing period. In principle, other units do not lend out when transferring. If it is really necessary to borrow it because of special circumstances, it should be approved by the leaders of the hospital. When lending, pay the main points, get the official receipt and return it within a time limit.
Borrowed files shall not be lent to other units or other personnel for use. Fifteenth foreign units to consult the litigation file, must hold a letter from the unit at or above the county level (letter from the unit at or above the county and township level), and approved by the leadership. Files involving state secrets and personal privacy shall not be consulted, and if they must be consulted, they shall be approved by the leaders of the hospital. If a case defense lawyer needs to consult the filed case file, he shall handle it through the case-handling judge. To extract the materials in the volume, only judgments, rulings and relevant conclusive documents can be extracted. If you need to extract other materials, it should be approved by the general office and the director of the office. The extracted materials shall be reviewed and signed. Sixteenth foreign units to request legal documents or other supporting materials, according to the requirements of the transfer, according to the provisions of the inspection and delivery, or notify the unit to send people to read. Seventeenth access or borrowing litigation files should be returned in a timely manner. When returning, if it is found that the files are dismantled, the documents are in short supply, altered, added, deleted and defaced, it should be reported to the leaders in time and traced. Eighteenth archives, departments and offices should set up a newspaper reading room to receive newspapers from people inside and outside the hospital, so as to facilitate confidentiality and supervision. Article 19 Archivists must strictly abide by the confidentiality system and keep state secrets. Do not exceed the system to provide documents to anyone or expand the scope of use, and do not disclose the contents of documents to others.
Four. Appraisal and transfer of archives Article 20 People's courts at all levels shall appraise the archives whose custody period has expired in accordance with the Provisions on the Custody Period of Litigation Archives of People's Courts. Appraisal work, by the general office, office director, judges and archivists composed of appraisal team, case by case review. The storage and destruction of files after examination and appraisal shall be handled in accordance with the above provisions.
