A license is required to purchase camphor trees

According to our newspaper (Reporter Zhang Yinfeng, Correspondent Li Li) "Permits are required for felling and transporting trees, and purchasing wood from unknown sources is absolutely not allowed." Recently, the case of Wu and six others who destroyed ecological and environmental resources was heard by the Yuelu District Procuratorate of Changsha City, Hunan Province. This is also the first case in Changsha City to pursue liability for compensation for ecological and environmental damage in the "full chain" from illegal felling of trees, transportation of trees to tree collection.

Between September 2020 and January 2021, Wu Moumou purchased the forest trees located in the collective mountain farm of Xueshi Street, Yuelu District, Changsha City from others and took them as his own, without applying for a forest felling license, etc. Without formalities, camphor trees, fir and other forest trees were illegally logged, and the volume of logged trees was 454.84 cubic meters. Experts determined that the actions of the six defendants had caused serious damage to the local forest vegetation and had a negative impact on the ecological environment, causing ecological damage worth more than 69,000 yuan and requiring ecological environment restoration costs of more than 34,000 yuan.

The procuratorial organ believes that the actions of Wu and six others should not only be held criminally responsible for the crimes of logging, illegal transportation of logging, and illegal purchase of logging, but also compensation for ecological damage. and other civil tort liability. The Yuelu District Procuratorate filed a criminal incidental civil public interest lawsuit with the court in accordance with the law, requiring the six defendants to jointly compensate for ecological damage restoration costs of more than 104,000 yuan within the scope of the amount of forest trees they participated in indiscriminate logging, transportation, and acquisition of forest trees, and to bear the expert appraisal and evaluation fee of 5,000 yuan in this case. Yuan, and made a public apology in the media at the municipal level and above. After trial, the court sentenced the six defendants to fixed-term imprisonment ranging from three years and eleven months to one year in accordance with the law. All civil public interest litigation requests submitted by the procuratorate were accepted by the court.

"Without illegal trade, there would be no illegal logging. To protect forest resources, we must not only prohibit and punish illegal logging and indiscriminate logging, but also cut off the circulation channels for illegal and indiscriminate logging." Liao Jiancong, deputy chief prosecutor of the Yuelu District Procuratorate, said that the procuratorate carries out a "whole chain" crackdown on indiscriminate logging, illegal transportation, and purchase of indiscriminately logged trees, and conducts all-round accountability through "criminal prosecution + public interest litigation prosecution", with the help of the procuratorial organs The power of ecological security builds a protective barrier for ecological security.
