You can also complain and report to the health administrative department, but if the facts do exist, the health administrative department will give administrative punishment at most. If you want to pursue criminal responsibility, you can report it to the procuratorate, and it is best to provide evidence or clues to prove the facts of the crime.
Article 1 This procedure is formulated in accordance with the provisions of the Administrative Punishment Law and relevant health laws and regulations in order to ensure that the health administrative organs correctly exercise the power of administrative punishment, protect the legitimate rights and interests of citizens, legal persons and other organizations, and safeguard public interests and social order.
Article 2 The term "administrative punishment" as mentioned in these Measures refers to the administrative punishment prescribed by health laws and administrative regulations such as warning, fine, confiscation of illegal income, order to stop production and business, and revocation of license made by the health administrative organ at or above the county level.
Article 3 These Measures shall apply to the administrative penalties imposed by health administrative organs at or above the county level on units or individuals that violate health laws, regulations and rules. Health institutions authorized by health laws and regulations to exercise the power of health administrative punishment shall be implemented in accordance with this procedure.
Article 4 When implementing administrative punishment, the health administrative organ must have clear facts, conclusive evidence, correct application of laws, regulations and rules, and adhere to the principles of investigation and evidence collection before adjudication, legality, appropriateness, fairness and openness, and combining punishment with education.
Fifth health administrative organs shall establish a supervision system of health administrative punishment. The health administrative organ at a higher level shall supervise the implementation of administrative punishment by the health administrative organ at a lower level, and the internal legal institution of the health administrative organ shall supervise the implementation of administrative punishment by this organ.
