What is the difference between a detention center and a prison?

1. Different jurisdictions:

Detention centers are under the jurisdiction of public security organs, prisons are under the jurisdiction of judicial organs, and they are subordinate to the Provincial Prison Administration (except Yancheng Prison). Generally, detention centers will be set up at the administrative level above the county (district) level, and some counties (districts) have more than one. The Ministry of Justice and the provinces set up prisons in cities. Some cities have several prisons, while others do not. There is no reciprocal relationship between prison and city.

2. Different living environments:

Detention center, a cell of about 20 square meters, generally holds 20-30 people in each cell, and the per capita space is less than 1 square meter. You can't lie flat, you can only sleep on your side.

Prison, according to the "Prison Construction Standards" of the Ministry of Justice: the per capita use area of building facilities for prisoners is more than 5 square meters, and each cell is occupied by no more than 20 people; Prisons should be firm, ventilated, transparent, clean and equipped with necessary heatstroke prevention and cold protection equipment; Provide sanitary facilities such as bathrooms.

3. Different food conditions:

The main source of detention center is the local financial burden. The monthly food expenses of detainees vary from 1 to 300 yuan. According to the provisions of the prison law, the annual food expenses of prisoners are linked to the local per capita economic level, and the financial resources are fully allocated every year according to the number of prisoners, which is earmarked for special purposes and cannot be misappropriated. In addition, prisoners in prisons need to undergo labor reform. In addition to handing over the income generated by labor to the prison and the state, the prison area also has its own sub-account funds, which can occasionally add meals to prisoners to improve their meals.
