(two) blind, deaf, dumb and minors are criminal defendants or criminal suspects, and if they have not entrusted a defense lawyer, they should obtain legal aid; Laid-off workers, low-income households and poor households with unemployment certificates are exempt from economic review. Migrant workers, disabled people, women, minors, elderly people over 60 years old, people suffering from serious diseases, soldiers who died in the line of duty or died, and citizens who claim their legitimate rights and interests according to law because of being courageous or protecting public interests may be exempted from economic review according to specific circumstances. Other applicants need to provide proof of economic difficulties issued by the town, village or other departments.
(3) Other criminal defendants and suspects, such as the disabled and the elderly, who are unable to hire a defense lawyer due to financial difficulties, can obtain legal aid;
(4) If a criminal defendant who may be sentenced to death does not entrust a defense lawyer, he shall obtain legal aid.
Legal basis:
Article 25 of the Law of People's Republic of China (PRC) on Legal Aid: If a criminal suspect or defendant in a criminal case falls into one of the following circumstances and does not entrust a defender, the people's court, the people's procuratorate and the public security organ shall notify the legal aid institution to appoint a lawyer as a defender: (1) Minors; (2) Persons with vision, hearing and speech disabilities; (3) adults who can't fully recognize their actions, and (4) people who may be sentenced to life imprisonment or death; (five) the defendant who applied for legal aid in the death penalty review case, and (six) the defendant who was tried in absentia; (seven) other personnel as prescribed by laws and regulations. In other criminal cases that are tried by ordinary procedures, if the defendant fails to entrust a defender, the people's court may notify the legal aid institution to appoint a lawyer as a defender.
