This revision changes "defense lawyer and other defenders" in Article 38 of the original Criminal Procedure Law to "defense lawyer and any other person". The original clause has been considered a "discriminatory" clause against rights defenders. Therefore, the subject of intervention in the judicial process should include the defender or any other person. In addition, this revision also made some technical wording, deleting the words "witnesses change their testimony" and other words in "Witnesses shall not be threatened or induced to change their testimony or commit perjury, or engage in other behaviors that obstruct the judicial process", because "committing perjury" and "perjury" are "Changing testimony" is redundant and does not conform to the conventions of legal language.
Article 306 of the "Criminal Law" stipulates: "In criminal proceedings, defenders and litigation agents destroy or falsify evidence, help parties destroy or falsify evidence, and threaten or induce witnesses to change their testimony about facts. Those who commit perjury shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention; if the circumstances are serious, they shall be sentenced to fixed-term imprisonment of not less than three years but not more than seven years. "This revision of the Criminal Procedure Law is consistent with the Criminal Law, but for the criminal subjects, the criminal procedure law stipulates. Subjects that interfere with judicial proceedings are not limited to defenders, but also include “any other person.” However, the criminal subjects in Article 306 of the Criminal Law are limited to “defenders and agents ad litem,” resulting in inconsistent legal provisions and the need for relevant judicial interpretations.
