Article 1 In order to strengthen the management of urban housing ownership, maintain the order of the real estate market and protect the legitimate rights and interests of housing owners, these Measures are formulated in accordance with the provisions of the People's Republic of China (PRC) Urban Real Estate Management Law.
Article 2 These Measures shall apply to the registration of house ownership on state-owned land in urban planning areas.
Article 3 The term "registration of house ownership" as mentioned in these Measures refers to the act that the real estate administrative department, on behalf of the government, registers the house ownership, mortgage right, mortgage right and other rights arising from the above rights, and confirms the ownership relationship of house property rights according to law.
The term "housing obligee" as mentioned in these Measures refers to the legal person, other organization and natural person who legally enjoys the housing ownership, land use right and other real estate rights within the scope of housing occupation.
The term "applicant for housing rights" as mentioned in these Measures refers to legal persons, other organizations and natural persons who have obtained housing and applied for housing registration, but have not obtained the certificate of housing ownership.
Article 4 The State practices the system of registration and certification of house ownership.
The applicant shall, in accordance with the provisions of the state, apply to the real estate administrative department of the people's government where the house is located (hereinafter referred to as the registration authority) for the registration of house ownership and obtain the certificate of house ownership.
Article 5 The house ownership certificate is the only legal evidence that the obligee has the house ownership according to law and exercises the right of possession, use, income and disposal of the house.
Housing rights registered according to law are protected by state laws.
Article 6 The registration of house ownership shall follow the principle that house ownership is consistent with the right subject of land use right within the scope of house occupation.
Article 7 The real estate management departments and land management departments of local people's governments at or above the county level may make and issue unified certificates of real estate ownership, and in accordance with the provisions of the Urban Real Estate Management Law, the confirmation and change of house ownership and land use rights within the scope of house occupation shall be recorded in the certificates of real estate ownership respectively. The style of real estate title certificate shall be reported to the construction administrative department of the State Council for the record.
Eighth the State Council city construction administrative departments responsible for the management of housing ownership registration.
The construction administrative departments of the people's governments of provinces and autonomous regions shall be responsible for the registration and management of housing ownership within their respective administrative areas.
The real estate administrative departments of the people's governments of municipalities directly under the central government, cities and counties shall be responsible for the registration and management of housing ownership within their respective administrative areas.
