Telecommunications as mentioned in these Regulations refers to the activities of transmitting, sending or receiving voice, words, data, images and other forms of information by using wired or wireless electromagnetic systems or photoelectric systems. Article 3 The provincial telecommunication management institution is the competent telecommunication department within the administrative region of this province, which shall supervise and manage the telecommunication industry in the whole province.
The dispatched offices set up by the provincial telecommunication management institutions shall exercise supervision and management functions in accordance with their duties. Article 4 Telecom business operators shall operate according to law, compete fairly, abide by business ethics, accept the inspection and social supervision by law enforcement departments, and provide users with rapid, accurate, safe, convenient and reasonable telecommunications services.
Telecommunication users should use telecommunication services according to law. Chapter II Market Management Article 5 Anyone who has been approved by the national telecommunications authorities to operate basic telecommunications services and trans-regional value-added telecommunications services must go to the provincial telecommunications administration for the record.
Engaged in value-added telecommunications business, business scope in the province, must be approved by the provincial telecommunications regulatory agencies to review, to obtain a value-added telecommunications business license.
Those who have not obtained the business license for telecommunication business shall not engage in telecommunication business activities. Licensed telecom operators must engage in telecom business activities within the approved projects and scope. Article 6 To operate value-added telecommunications services, the following conditions shall be met:
(1) The operator is a legally established company;
(2) Having a place and funds suitable for engaging in business activities;
(3) Having professional and technical personnel suitable for carrying out business activities;
(4) Having a feasibility study report;
(5) Having a technical networking scheme;
(6) Reputation and commitment to provide users with long-term services;
(seven) other conditions stipulated by the state. Article 7 The interconnection between telecommunication networks shall follow the principles of technical feasibility, economic rationality, fairness and justice, and mutual cooperation.
Interconnection institutions established by telecom operators shall establish a normal working contact system to ensure smooth working channels between telecom operators and telecom management institutions and between telecom operators. Article 8 The code number resources of telecommunication networks belong to the state, and the use of code number resources shall be subject to the examination and approval system. Provincial telecommunications management institutions are responsible for the management of code number resources within their administrative areas within the scope authorized by the state.
No unit or individual may use, transfer, lease or change the use of telecommunication network code number resources without authorization. Article 9 To establish a business place for Internet service, it is necessary to obtain the approval documents from the public security and cultural departments, and obtain a business license after being examined and approved by the provincial telecommunications regulatory agency and registered in industry and commerce. Article 10 To apply for the establishment of a business place for Internet service, the following conditions shall be met:
(1) Having a business place suitable for business activities, safe and reliable, and complete safety facilities;
(2) Having computers and auxiliary equipment suitable for business activities;
(3) Having professional technicians and professional technical support suitable for the scale of operation;
(4) Having a sound network information security system;
(5) Having corresponding technical measures for network security;
(6) Having full-time or part-time network information security management personnel;
(seven) management personnel and safety management personnel have been trained by relevant departments;
(8) Abide by laws, regulations and other provisions. Eleventh to apply for the sale or maintenance of mobile telephone service, shall be approved by the provincial telecommunications regulatory agencies, to obtain a business license.
To apply for a license for sales or maintenance of mobile phones, the following conditions shall be met:
(1) Having a business license or name pre-approval notice issued by the industrial and commercial department;
(2) Having business premises, funds, instruments and other equipment suitable for sales or maintenance;
(3) Providing users with means to identify the true and false signs of network access;
(4) Measures and systems for providing users with after-sales services such as guaranteed repair, replacement and return;
(five) maintenance personnel and other management personnel who have obtained professional qualification certificates. Article 12 No unit or individual may sell or use telecommunication terminal equipment without network access license and network access signs.
Telecom operators shall allow access to the network for the telecom terminal equipment acquired in network access license. Thirteenth operators engaged in the lease or sale of telecommunications pipelines must have a license to operate basic telecommunications services issued by the telecommunications regulatory agencies. Fourteenth technical workers in the telecommunications industry to implement the occupation qualification certificate system. Employees of technical jobs in the telecommunications industry must pass professional skill appraisal and obtain professional qualification certificates before they can take up their posts. Article 15 No unit or individual may forge, falsely use, lease, alter, transfer or lend the business license, network access license, professional qualification certificate and relevant approval documents.
