Measures of Shanghai Municipality on Traceability Management of Food Safety Information

Article 1 (Purpose and Basis)

In order to strengthen the traceability management of food safety information in this Municipality, implement the main responsibility of producers and operators, improve the efficiency of food safety supervision, and protect public health and consumers' right to know, these measures are formulated in accordance with the provisions of relevant laws and regulations and combined with the actual situation of this Municipality. Article 2 (Traceability Categories and Varieties)

The following categories of food and edible agricultural products in this Municipality shall implement information traceability management in the production (including planting, breeding and processing), circulation (including sales, storage and transportation) and catering services within the administrative area of this Municipality:

(1) Grain and its products;

(2) Animal products and their products;

(3) Poultry and its products and products;

(4) vegetables;

(5) fruit;

(6) Aquatic products;

(7) bean products;

(8) Dairy products;

(9) Edible oil;

(ten) other categories of food and edible agricultural products approved by the Municipal People's government.

The municipal food and drug supervision department shall, jointly with the municipal departments of agriculture, commerce, health and family planning, determine the specific varieties and time of food and edible agricultural products (hereinafter referred to as traceability food and edible agricultural products), report them to the Municipal Food Safety Committee for approval, and announce them to the public. Article 3 (Responsibilities of Producers and Operators)

Traceable food and edible agricultural products producers and operators shall, in accordance with the provisions of these measures, use information technology to fulfill the corresponding information traceability obligations, accept social supervision and assume social responsibilities.

The measures referred to in traceability food and edible agricultural products producers and operators, including production enterprises engaged in traceability food and edible agricultural products production and operation, farmers' professional cooperative economic organizations, slaughterhouses (fields), wholesale enterprises, wholesale markets, warehousing and distribution enterprises engaged in wholesale business, standardized vegetable markets, supermarket chains, medium-sized and above food stores, collective dining and distribution units, central kitchens, school canteens, medium-sized and above hotels and chain catering enterprises.

Encourage other food and edible agricultural products producers and operators to fulfill the corresponding information traceability obligations with reference to the provisions of these measures. Article 4 (Government Duties)

The municipal and district (county) people's governments shall lead the food safety information traceability work within their respective administrative areas, incorporate the funds required for the food safety information traceability work into the fiscal budget at the same level, and evaluate the food safety information traceability work carried out by relevant departments. Article 5 (Responsibilities of US Food and Drug Administration)

The municipal food and drug supervision department is responsible for the organization, promotion and comprehensive coordination of food safety information traceability in this Municipality, and specifically undertakes the following duties:

(1) On the basis of integrating the food and edible agricultural products information traceability system, build a unified food safety information traceability platform in the whole city (hereinafter referred to as the food safety information traceability platform);

(two) responsible for the construction, operation and maintenance of information traceability system in food production and catering services;

(three) in conjunction with the relevant departments to formulate the specific implementation plan and related technical standards of these measures;

(four) food production, circulation, catering services and edible agricultural products circulation information traceability, the implementation of supervision and management and administrative law enforcement. Article 6 (Responsibilities of the Municipal Administrative Department of Agriculture)

The municipal administrative department of agriculture shall undertake the following duties:

(a) responsible for the construction, operation and maintenance of the information traceability system for planting, breeding and primary processing of edible agricultural products;

(two) the information traceability of edible agricultural products planting, breeding, primary processing and livestock and poultry slaughter, and the implementation of supervision and management and administrative law enforcement. Article 7 (Responsibilities of Municipal Commercial Department)

The Municipal Department of Commerce shall undertake the following duties:

(a) responsible for the construction, operation and maintenance of food, edible agricultural products circulation and livestock and poultry slaughter information traceability system;

(two) to guide and supervise the producers and operators in the field of food and edible agricultural products circulation to fulfill the obligation of information traceability. Article 8 (Responsibilities of Relevant Departments of Districts and Counties)

District (county) market supervision, agriculture, commerce and other departments shall, in accordance with their respective responsibilities, be responsible for the supervision and administration of food and edible agricultural products information traceability and administrative law enforcement within their respective jurisdictions, as well as the operation and maintenance of relevant information traceability systems. Article 9 (Responsibilities of Other Relevant Departments)

The entry-exit inspection and quarantine department shall, in accordance with the requirements of traceability management of food safety information, cooperate with the provision of relevant information on imported traceability food and edible agricultural products.

Development and reform, finance, economic informatization, health and family planning departments shall, according to their respective responsibilities, do a good job in food safety information traceability. Article 10 (System and Platform Docking)

The information traceability system built by the municipal food and drug supervision, agriculture and commerce departments shall be connected with the food safety information traceability platform.

Encourage qualified producers, operators, trade associations and third-party institutions to establish food and edible agricultural products information traceability system, and connect with the food safety information traceability platform.

The municipal food and drug supervision department shall, jointly with the municipal agricultural and commercial departments, formulate technical standards for the docking of the information traceability system of government departments, producers and operators, industry associations and third-party institutions with the food safety information traceability platform.
