The competent department of informatization of the people's governments of all districts and counties shall be responsible for the construction and management of informatization projects in these districts and counties.
The relevant departments of the city, district and county shall, in accordance with their respective responsibilities, supervise and manage the information engineering construction. Article 4 The construction of information engineering in this Municipality shall follow the principles of overall planning, interconnection, resource sharing and security, and prevent blind investment and repeated construction. Article 5 The municipal, district and county people's governments shall incorporate the construction of information infrastructure into the overall planning of urban construction and the overall planning of village and market town construction. The pipeline construction in the urban public information infrastructure of this Municipality shall be uniformly planned, constructed and managed. Article 6 The informatization construction of this Municipality must conform to the capital informatization development plan.
The Municipal Information Office shall, jointly with the municipal planning, finance and other relevant competent departments, formulate the annual plan for information engineering construction in this Municipality, and organize and supervise the implementation. Seventh major information engineering projects with an investment of more than 2 million yuan (hereinafter referred to as major projects), the municipal planning department and other competent departments in the examination and approval of the project, the municipal finance department in the examination and approval of funds, should cooperate with the Municipal Information Office to review.
For information engineering projects other than those specified in the preceding paragraph, the construction unit shall report the relevant project report and design scheme to the municipal or district/county information department for the record before the project starts.
The specific procedures or methods for examination and filing as stipulated in this article shall be separately stipulated by the Municipal Information Office and the municipal planning and finance departments. Article 8 The Municipal Information Office shall organize a review of the planning layout, safety system, technical standards and other related contents of major projects, and make a reply on whether they are qualified within 30 days.
If the examination is unqualified, the relevant competent department shall not approve the project; Belong to the financial investment, the financial sector will not grant funds. Article 9 Information engineering construction shall be subject to tender according to law. Tenth units engaged in the design, development, implementation, service and security of information networks and information application systems shall be certified by the national or municipal information department in accordance with the provisions. Units without qualification certification shall not undertake or undertake information engineering in the name of other units; The certified unit shall not undertake information engineering beyond its qualification level.
If it is necessary to obtain the qualification certification of the construction administrative department according to law, it shall also obtain the relevant qualification certification of the construction administrative department. Eleventh construction units shall not contract out information engineering projects to units that do not have the corresponding qualification grades. Twelfth units engaged in the design, development, implementation and service of information engineering shall implement the relevant national standards, industry standards and local standards of this Municipality. Thirteenth in the construction of information engineering, security system should be designed and built at the same time. The scheme design and construction of the security system should meet the needs of the safe operation of the information system and ensure the corresponding investment.
The design scheme, products used, acceptance and related services of information engineering shall implement the relevant standards of information system security.
Major projects shall pass the information system security assessment and certification, and shall not be put into operation without assessment and certification. Article 14 Major projects shall be subject to supervision.
The Municipal Information Office shall supervise and inspect the quality of major projects. Fifteenth construction units in the organization to complete major projects, should have the participation of the Municipal Information Office. Major projects that have not been accepted or failed to pass the acceptance test shall not be put into use. Article 16 This Municipality implements the information engineering quality warranty system. The unit undertaking the informatization project shall sign a contract with the construction unit to fulfill the warranty responsibility of the informatization project. The warranty period shall be no less than two years from the date of project completion acceptance. Seventeenth construction units in violation of the provisions of the second paragraph of article seventh, eleventh, thirteenth, fourteenth, the first paragraph of article fifteenth, the municipal information office shall be ordered to make corrections. If the circumstances are serious and cause heavy losses, the people's government at a higher level or the competent department shall investigate the administrative responsibility of the person in charge of the unit and the relevant personnel in accordance with the relevant provisions. Eighteenth units undertaking information engineering in violation of the provisions of the first paragraph of Article 10, Article 12, Article 13, Paragraph 1, Paragraph 2 and Article 16 of these measures, the Municipal Information Office shall order it to make corrections and give a warning; If the circumstances are serious, a fine of less than 30 thousand yuan may be imposed, and the relevant qualifications may be revoked or reduced; If losses are caused, the relevant responsible units shall be liable for compensation according to law.
