What procedures and materials are needed for marriage registration?

The marriage registration process is roughly as follows:

(1) application

Those who meet the conditions for marriage registration shall bring relevant certification materials and registration photos, and both parties shall apply for marriage registration at the marriage registration office where one party's permanent residence is located, and both parties shall fill in the documents for applying for marriage registration on the spot.

The documents and materials for applying for marriage registration depend on individual circumstances. For example, when mainland residents apply for marriage registration, they need to hold their ID card, household registration book, marriage examination certificate, single certificate and a statement that they are not related by blood (lineal blood relatives and collateral blood relatives within three generations). If it is a divorce, you need to bring a divorce certificate to apply for remarriage.

Foreigners (including foreigners residing or temporarily residing in China, China people and foreigners residing in China) applying for marriage in Chinese mainland must hold their valid passports or nationality certificates, valid residence permits for foreigners, and marriage status certificates issued by embassies and consulates in China.

(2) Review

The marriage registration office will check and review the submitted application materials to find out whether the submitted marriage application is within the conditions. If the application materials submitted are unclear, the marriage registration authority shall ask the parties concerned and ask them to provide corresponding certification materials when necessary.

(3) Registration (Licensing)

If the application submitted by the parties meets the conditions for marriage, the marriage registration authority shall register it and issue a marriage certificate; For those who have experienced divorce, the marriage registration office will cancel their divorce certificates; If necessary, a written statement will be issued to those who do not meet the conditions for marriage registration, explaining the reasons for not registering.

What procedures and documents do you need for divorce?

The process of divorce registration is roughly as follows:

(1) application

If a husband and wife voluntarily divorce in the Mainland, they shall sign a divorce agreement in accordance with the provisions, jointly apply to the relevant marriage registration authority, and provide the following application materials in accordance with the provisions:

1. Marriage certificate issued by the Mainland Marriage Registry or Chinese embassies and consulates abroad;

2. Valid and compliant identity documents, such as household registration book, ID card, Hong Kong, Macao and Taiwan pass, passport, etc. ;

3. Fill in the application for divorce registration.

(2) Accept

The marriage registrar shall, in accordance with the relevant provisions, conduct a preliminary examination of the above-mentioned materials submitted by the parties. After the divorce application is found to be correct in the first instance, the parties concerned will receive the Receipt of Accepting the Application for Divorce Registration. If the application conditions for divorce registration are not met, the marriage registration authority will not accept it, and if the party concerned requests to issue a Notice of Not Accepting the Application for Divorce Registration, it shall issue it.

(3) cooling-off period

Within 30 days from the date when the marriage registration office receives the application for divorce registration and delivers the receipt of the application for divorce registration to the parties concerned, any party who does not want to divorce may submit his identity certificate and the receipt of the application for divorce registration to the marriage registration office that accepts the application for divorce registration (if the receipt is lost, no written explanation is required), and fill out the Application for Withdrawal of Divorce Registration and other relevant documents in person. After the marriage registration authority has verified that it is correct, it will issue a Confirmation Letter for Cancellation of Divorce Registration. Within 30 days after the expiration of the cooling-off period for divorce, if both parties fail to apply for a divorce certificate at the marriage registration office, the application for divorce registration shall be deemed to have been withdrawn.

(4) Review

Within 30 days after the expiration of the cooling-off period for divorce (if the last day of the period expires is a holiday, the first day after the holiday is the date of the period), both parties shall bring relevant documents and materials as required, such as divorce agreement, marriage certificate, two recent 2-inch bareheaded photos of both parties, passports, passes, ID cards, etc. , and apply for a divorce certificate at the marriage registry. The marriage registration office will conduct a review according to the regulations, and the parties who do not meet the requirements for divorce registration will not handle it. When necessary, the marriage registration authority may, at the request of the parties concerned, issue a notice not to register for divorce.

(5) Registration and certification
