The above seven points must be determined before they are established.
The following is the establishment process:
1. Apply to local civil affairs departments (local foundations apply to local municipal civil affairs departments and national foundations apply to provinces? Ministry of Civil Affairs), generally apply to the Administration of Civil Organizations for name approval.
2. After approval, declare the members of the board of directors to the Civil Affairs Bureau, and submit the resumes and identity information of relevant personnel.
3. For the establishment and filing of the foundation articles of association, the Civil Affairs Bureau will refer to the articles of association for you, and make amendments and filing according to your actual situation.
4. Proof of the right to use the residence
5. Letter of commitment from the fund source unit or individual.
6. Full-time commitment letter of the Secretary-General
7. After passing the preliminary examination, conduct bank capital verification.
8. Application for tax exemption qualification of foundation
If these are all right, you can formally join the ranks of public welfare foundations!

Recently, according to the actual requirements of the Civil Affairs Department of Henan Province and Shenzhen City, the establishment of the Foundation has been updated as follows:
I. Policy basis:
Notice of the Ministry of Civil Affairs on the Public Solicitation of the Regulations on the Administration of Registration of Social Organizations (Draft for Comment) (20 18)
According to the main changes in the requirements of the Exposure Draft:
The foundation is registered by the provincial civil affairs department, and there is no registration authority at or below the prefecture level.
The registered amount of the foundation will be raised to a minimum of 8 million yuan and 60 million yuan at the national level. The minimum number of foundations with the Ministry of Civil Affairs as the competent business unit is 654.38+0 billion, and they are monetary funds.
Newly registered foundations are no longer divided into public offerings and non-public offerings.
The foundation is a charitable organization (but it has to go through the identification steps when it is established)
The following social organizations shall be established and directly registered in accordance with the provisions of these regulations:
(1) Trade associations and chambers of commerce;
(two) scientific and technological social organizations and social service institutions engaged in academic research and exchange activities in the fields of natural science and engineering technology;
(3) Charitable social organizations that provide services such as helping the poor, helping the needy, helping the elderly, saving orphans, caring for the sick, helping the disabled, providing disaster relief, helping doctors and helping students;
(four) in order to meet the living needs of urban and rural community residents, urban and rural communities active in the community serve social groups and social service institutions.
6. The requirements for the qualifications of sponsors and responsible persons of social organizations are stricter.
There is one more sponsor of the foundation than before: it is included in the list of serious violations of law and dishonesty.
II. Changes in current registration:
The registration of the overall foundation is getting stricter and stricter.
At present, there is little change in registration, but the minimum registered capital is required to be greater than 2 million.

Update the latest policy changes when you have time:
Civil affairs bureaus all over the country (except municipalities directly under the central government) have recovered the registration right of the foundation from the provincial offices on September 30, 2022. As for how to change the foundation registration in the future, we are all waiting for the policy. According to the system, Guangdong province may become: the registration right is in the provincial office, and the audit right is at the municipal level.
On the whole, local civil affairs bureaus have begun to implement the 20 18 Regulations on the Registration and Management of Social Organizations (Draft for Comment), and it is believed that the Ministry of Civil Affairs will soon issue formal legal provisions.
