Regulations of Jinzhong Municipality on Prevention and Control of Dust Pollution

Chapter I General Provisions Article 1 In order to strengthen the prevention and control of dust pollution, improve the quality of atmospheric environment, safeguard public health and promote the construction of ecological civilization, these Regulations are formulated in accordance with the Environmental Protection Law of People's Republic of China (PRC), the Law of People's Republic of China (PRC) on the Prevention and Control of Air Pollution and the Regulations of Shanxi Province on the Prevention and Control of Air Pollution. Article 2 These Regulations shall apply to the prevention and control of dust pollution and its supervision and management activities within the administrative area of this Municipality. Article 3 The term "dust pollution" as mentioned in these Regulations mainly refers to dust pollution from construction, roads, yards, industrial and mining enterprises and soil. Article 4 The prevention and control of dust pollution shall follow the principles of government leading, departmental supervision, public participation and comprehensive management, and adhere to territorial jurisdiction, source control, prevention first and responsibility for damage. Article 5 All units and individuals shall fulfill their obligations to prevent and control dust pollution and take effective measures to prevent and reduce dust pollution. Sixth people's governments at all levels and relevant departments and units should strengthen the publicity and education of laws and regulations on the prevention and control of dust pollution, and raise the awareness of the whole society to participate in the prevention and control of dust pollution.

The news media should strengthen the public welfare propaganda of dust pollution prevention and control, and supervise the work of dust pollution prevention and control by public opinion. Seventh to encourage and guide the popularization and application of new technologies, new processes and new equipment for dust pollution prevention and control. Chapter II Responsibility for Prevention and Control Article 8 The Municipal People's Government is responsible for organizing and leading the prevention and control of dust pollution in the whole city, establishing a mechanism of overall coordination, long-term management and information sharing, formulating a master plan for prevention and control of dust pollution, and establishing a target responsibility system for prevention and control of dust pollution such as assessment, listing supervision and interviews.

County (city, district) people's government is responsible for the prevention and control of dust pollution within its jurisdiction and performs the following duties:

(a) to formulate special plans and specific prevention and control plans for the prevention and control of dust pollution, clarify the objectives and measures for the prevention and control of dust pollution, and organize their implementation;

(two) the establishment of dust pollution prevention and control joint meeting, information sharing, capital investment guarantee mechanism;

(3) Establishing an emergency mechanism for dust prevention and control in heavily polluted weather;

(four) units and individuals that have made remarkable achievements in the prevention and control of dust pollution shall be commended and rewarded.

Township (town) people's governments and sub-district offices shall, in accordance with their respective responsibilities, carry out relevant work in the prevention and control of dust pollution within their respective jurisdictions. Article 9 The competent department of ecological environment shall exercise unified supervision and management over the prevention and control of dust pollution within their respective administrative areas; Organize dust pollution monitoring, determine and publish key dust pollution sources, assess the completion of key dust pollution prevention and control tasks, and implement rewards and punishments.

The competent department of ecological environment is responsible for the supervision and management of the prevention and control of dust pollution in industrial and mining enterprises such as concrete (asphalt) mixing stations, ready-mixed mortar stations and water-stabilized mixing stations. Tenth housing and urban construction department is responsible for the supervision and management of housing construction, municipal infrastructure construction and building (structure) demolition, decoration construction, building materials stacking and other dust pollution prevention and control.

The urban management department is responsible for the supervision and management of dust pollution prevention and control in the process of municipal maintenance engineering construction, municipal road excavation and restoration construction, landscaping construction, construction waste, domestic waste stacking, collection, removal and cleaning of municipal roads and public places.

The competent department of transportation is responsible for the supervision and management of county and township highway engineering construction and its affiliated mixing stations, highway maintenance and greening operations, and the prevention and control of dust pollution such as material handling, transportation and stacking.

Highway management departments are responsible for the supervision and management of national and provincial highway engineering construction and its affiliated mixing stations, highway maintenance and greening operations, as well as the prevention and control of dust pollution such as material handling, transportation and stacking.

The public security traffic management department is responsible for setting the area and time when goods transport and freight vehicles that are prone to dust pollution are prohibited and restricted, and investigating and dealing with relevant road traffic violations according to law.

The water conservancy department is responsible for the supervision and management of dust pollution prevention and control in water conservancy project construction.

The competent department of planning and natural resources shall be responsible for the supervision and management of the prevention and control of dust pollution on the bare ground reserved in the urban planning area, and determine the location of the construction waste disposal site and the comprehensive utilization site of construction waste resources.

The competent department of commerce shall be responsible for the supervision and management of dust pollution prevention and control in renewable resource recycling business premises.

The supervision and management of the prevention and control of dust pollution in non-coal mining enterprises shall be the responsibility of the competent department of industry determined by the people's government at or above the county level according to local conditions.

Development and reform, finance, agriculture and rural areas, civil air defense and other departments shall supervise and manage the prevention and control of dust pollution according to their respective responsibilities. Article 11 The construction unit shall specify the responsibility of the construction unit for the prevention and control of dust pollution in the construction contract, include the cost of dust pollution prevention in the project cost, and pay it in full to the construction unit for special purposes. Twelfth construction units engaged in building construction, municipal infrastructure construction, river regulation and demolition of buildings (structures) shall implement the main responsibility of dust pollution prevention and control, formulate the implementation plan of dust pollution prevention and control during construction, and file with the relevant supervision and management departments. Publicize the responsible person, prevention and control objectives, prevention and control measures, dust supervision and management departments and other information in a conspicuous position on the construction site, and accept social supervision.
