The developer completes the architectural planning scheme design according to the fixed-point planning notice and the design planning requirement notice (including the book "Four Drawings and One Book", that is, the general plan, the positioning plan, the vertical design plan, the comprehensive plan of the pipeline and the manual).
5. Apply for the construction land planning permit with the notice of design and planning requirements and the approval of the feasibility study report plus the approved planning and design scheme.
6. After the project is included in the annual plan, it is necessary to apply for a construction project planning permit before applying for a construction permit. At this point, the planning process is completed.
7. Procedures for land acquisition and demolition: Land acquisition can only be carried out after obtaining the planning permit for construction land, and application for demolition can only be made after obtaining the temporary land use permit or land use right certificate for construction and demolition.
Land requisition and demolition is an important work before the project starts. The completion of land acquisition and demolition is one of the necessary conditions for applying for the start of the project.
8. After the project completes the planning procedure and has the conditions for commencement, apply to the Municipal Construction Committee for commencement and obtain the construction application certificate.
Second, what is a construction permit?
The construction permit is the approval document for the construction unit to meet various construction conditions and allow the construction to start. It is the legal certificate for the construction unit to carry out the project construction, and it is also one of the main bases for the registration of house ownership. Construction projects without construction permits are illegal buildings and are not protected by law. When all kinds of construction conditions are complete, the construction unit shall start the project according to the plan, go through the construction permit formalities with the construction administrative department of the people's government at or above the county level where the project is located, and obtain the construction permit. Without obtaining the construction permit, construction shall not be started without authorization.
Three. Relevant laws and regulations
In order to standardize the qualification management of construction enterprises, according to the Regulations on the Qualification Management of Construction Enterprises (Order No.2004)
No, hereinafter referred to as the "Regulations") and the Qualification Standards for Construction Enterprises (Jianshi [20 14] 159, hereinafter referred to as the "Standards") and relevant laws and regulations, these implementation opinions are formulated.
I. Qualification application and licensing procedures
(a) to apply for the qualification of a construction enterprise, it shall obtain the Business License for Enterprise as a Legal Person issued by the administrative department for industry and commerce according to law.
(2) An enterprise applying for the qualification of a construction enterprise licensed by the Ministry of Housing and Urban-Rural Development shall apply in accordance with the application procedures stipulated in Article 12 of the Regulations. Enterprises affiliated to the army may apply to the Ministry of Housing and Urban-Rural Development by the Engineering Management Bureau of the Barracks Department of the General Logistics Department.
(3) An enterprise applying for the qualification of a construction enterprise licensed by the provincial competent department of housing and urban-rural construction shall apply in accordance with the application procedures published by the provincial competent department of housing and urban-rural construction on its portal website.
(4) An enterprise applying for the qualification of a construction enterprise licensed by the competent department of housing and urban-rural construction of the municipal people's government with districts shall apply according to the application procedures published by the competent department of housing and urban-rural construction of the municipal people's government with districts on its portal website.
(5) Where an enterprise applies for upgrading or adding new qualifications, its assets, technical directors, registered construction engineers and personnel with professional and technical titles shall meet the standard requirements of all existing construction enterprise qualifications.
(6) Enterprises applying for qualification upgrading are not limited by the number of years.
(seven) the qualification licensing authority shall publish the results of enterprise qualification licensing on its portal website.
(eight) the qualification licensing authority shall keep all written materials such as the application and examination of construction enterprises for at least 5 years.
(9) Where an enterprise applies for qualification upgrading or qualification addition, the qualification licensing organ shall verify whether there are any illegal acts listed in Article 23 of the Regulations in the last year, and take the verification results as the basis for qualification licensing.
(10) The contents of building rectification and translation, structural reinforcement, special hoisting, special lightning protection, etc., which are included in the standard for special engineering contracting, can be approved by the provincial housing and urban-rural construction department according to the personal performance of the professional and technical personnel and technical leaders of the enterprise.
If the provincial housing and urban-rural construction department needs to increase the qualification standard of special project contracting according to the special situation in the region, it can refer to the conditions of the "Qualification Standard for Special Project Contracting", and after being approved by the Ministry of Housing and Urban-rural Construction according to legal procedures, it will be promulgated and implemented by the provincial housing and urban-rural construction department that filed the application, and it will be implemented only within the province.
(eleven) the first time an enterprise applies for the qualification of a construction enterprise, its qualification grade shall be approved according to the minimum qualification grade.
Enterprises that have obtained qualifications can add three series of qualifications: general construction contracting, professional contracting and construction labor service qualification, and the number is unlimited.
(12) Enterprises that have obtained the comprehensive qualification of engineering design and the first-class qualification of the industry, but have not obtained the qualification of construction enterprises, can directly apply for the first-class qualification of construction general contracting of corresponding categories, and other engineering design enterprises should apply for the qualification of construction enterprises according to the requirements of the first application. See Annex 4 for the comparison table of engineering design qualification and construction general contracting qualification category.
Enterprises that have obtained the comprehensive qualification of engineering design and the first-class qualification of the industry, but have not obtained the qualification of construction enterprises, directly apply for the general contracting qualification of the corresponding category and below, and the general contracting performance of the corresponding scale can be declared as the performance of engineering representatives.
(13) The Ministry of Housing and Urban-Rural Development is responsible for reviewing the on-site management personnel who have obtained the qualification license of construction enterprises and the skilled workers who hold post certificates, as well as the personnel with intermediate titles or above who are directly declared by the construction enterprises directly managed by the state-owned assets supervision department of the State Council, except those who are qualified in professional departments such as highways, water conservancy, communications, railways and civil aviation; The construction enterprises directly managed by the provincial housing and urban-rural construction departments and the state-owned assets supervision department of the State Council will report the audit results together with the enterprise application materials, and the Ministry of Housing and Urban-Rural Development will publicize the audit results together with the basic information of the enterprise on the website of the Ministry of Housing and Urban-Rural Development, and will no longer organize the audit.
(14) In case of merger, division, reorganization, reorganization or inter-provincial change, it shall be handled in accordance with the relevant provisions of the Notice of the Ministry of Housing and Urban-Rural Development on Relevant Issues Concerning Qualification Verification of Construction Engineering Enterprises in the Case of Reorganization, Merger and Division (Jianshi [] No.79).
