Urban and rural planning as mentioned in these Regulations includes urban system planning, urban planning, town planning, township planning and village planning. Article 3 The preparation of urban and rural planning shall be based on the national economic and social development planning, and be linked with the land use and ecological environment protection planning to meet the needs of the long-term development of Bijie Experimental Area. Article 4 The formulation and implementation of urban and rural planning should be people-oriented, and the new urbanization strategy and rural revitalization strategy should be implemented as a whole, reflecting regional culture, characteristic culture and national culture, and adhering to the principles of ecological priority, green development, adapting measures to local conditions, rational layout, land conservation, intensive development and planning before construction. Article 5 The administrative department of urban and rural planning of the Municipal People's Government shall be responsible for the relevant planning and management within the administrative area of this Municipality. The competent department of urban and rural planning of the people's government at the county level shall be responsible for the management of urban and rural planning within their respective administrative areas.
The administrative department of urban and rural planning of the Municipal People's Government is responsible for the planning and management of the central city; The competent department of urban and rural planning administration of the Municipal People's Government is responsible for planning and management matters outside the scope of the central city.
The central city mentioned in the preceding paragraph refers to the centralized bearing area of the leading function of the city where the Municipal People's Government is located. Sixth cities and counties (districts) set up urban and rural planning committees, towns and villages set up urban and rural planning management committees, and cities and counties (districts) set up urban and rural planning supervision committees.
The Urban and Rural Planning Committee and the Urban and Rural Planning Management Committee are composed of NPC deputies, CPPCC members, experts, public representatives in their respective jurisdictions and personnel from relevant functional departments of the people's government at the corresponding level. The proportion of NPC deputies, CPPCC members, experts and public representatives shall not be less than half of the total number of members.
The Urban and Rural Planning Supervision Committee consists of relevant personnel of the relevant special committees of the people's congresses at the corresponding levels, deputies to the National People's Congress, members of the Chinese People's Political Consultative Conference, urban and rural planning inspectors, experts and public representatives in the areas under their jurisdiction. The members of the Urban and Rural Planning Supervision Committee shall not be composed of members of the Urban and Rural Planning Committee and the Urban and Rural Planning Management Committee. Seventh city and county (District) urban and rural planning committee is responsible for reviewing and evaluating the major issues involved in the formulation and revision of urban and rural planning within their respective administrative areas.
The township urban and rural planning management committee shall implement the matters agreed by the urban and rural planning committee.
City, county (District) Urban and Rural Planning Supervision Committee shall supervise the matters agreed by the Urban and Rural Planning Committee, the implementation of the Urban and Rural Planning Management Committee and the implementation and planning of relevant laws and regulations by relevant units. Article 8 The exploitation of mineral resources in urban and rural planning areas shall not affect the implementation of urban and rural planning. Mining enterprises shall take measures to comprehensively control and restore mining areas and subsidence areas according to law. Ninth people's governments at or above the county level shall include the funds for urban and rural planning and management in the fiscal budget at the corresponding level. Article 10 Encourage the research, popularization and application of advanced technologies in urban and rural planning, promote the standardization and informatization construction of urban and rural planning, and improve the scientific and technological level and management efficiency of urban and rural planning. Chapter II Formulation of Urban and Rural Planning Article 11 People's governments at all levels shall organize the formulation of urban system planning, overall urban planning, overall town planning, township planning and village planning according to law. Twelfth towns, townships and villages in urban planning areas and villages in town and township planning areas are no longer classified as planning areas. Towns, townships and villages other than urban construction land shall be planned in accordance with the requirements of higher-level planning.
The planning of towns, townships and villages outside the overall urban planning and construction land shall be organized by the Municipal People's Government, audited by the administrative department of urban and rural planning of the Municipal People's Government, and reported to the Municipal People's Government for the record. Article 13 Urban design shall be carried out for important areas, important nodes, main landscape axes, main traffic trunk lines and specific areas determined in urban planning, and urban design shall put forward planning control requirements for the overall form, features, development intensity, public space, landscape corridors, building height and volume color of urban space. The content of urban design should be included in the index system of regulatory detailed planning as the basis for the preparation of regulatory detailed planning. Fourteenth village planning includes village planning and residential construction planning. Administrative villages shall prepare village plans, and villages with more than 30 households within the administrative villages shall prepare residential construction plans according to the village plans, and villages with less than 30 households may put forward control requirements in light of actual conditions.
The planning period of village planning is generally 10 year, and the Township People's Government shall complete the revision before the expiration of the village planning period. Fifteenth township and town people's governments shall publicize the draft village planning for not less than 30 days. After the draft village planning is discussed and adopted by the villagers' meeting or the villagers' representative meeting, it shall be submitted to the people's government at the county level for approval by the township and town people's governments. Article 16 The administrative department of urban and rural planning of the Municipal People's Government shall, jointly with relevant departments, organize the formulation of guidelines for the design of rural residential buildings, compile the general atlas of rural residential design, and report it to the Municipal People's Government for approval.
