In recent years, our commission has promoted the establishment of intellectual property protection workstations in industrial design, small and medium-sized enterprises, smart watch wear and other industry associations, and provided publicity and training, rights protection assistance and other intellectual property services for member enterprises, which achieved good results and had a positive impact. In order to implement the strictest intellectual property protection, create a world-class business environment, and comprehensively improve the level of industrial intellectual property protection in our city, our Committee decided to promote this experience throughout the city, encourage more industry associations to establish intellectual property protection workstations, and give necessary inclination and support in policy. The relevant matters are hereby notified as follows:
First, the significance of establishing an intellectual property protection workstation
The Shenzhen Municipal Party Committee and Municipal Government has always attached great importance to intellectual property protection, taking the strictest intellectual property protection as an important guarantee to create a good business environment, and advocating the establishment of a large intellectual property protection system with judicial protection as the leading factor, administrative protection as the support, arbitration and mediation, industry self-discipline and social supervision as the supplement. Industry self-discipline and enterprise self-protection are important components of Shenzhen's intellectual property protection system. At present, the international economic situation is complicated and the international trade friction is increasing. Enterprises in our city are facing unprecedented intellectual property challenges when they go out. Only enterprises with good self-protection ability and industries with strong self-discipline management ability can effectively resist the external risks of intellectual property rights and successfully explore the international market. To encourage trade associations with intellectual property protection needs and capabilities to set up intellectual property protection workstations is to give full play to the collective advantages of trade associations, and provide all-round rights protection services such as intellectual property publicity and training, information retrieval, legal consultation and dispute resolution for association members by establishing corresponding industrial intellectual property system and self-discipline mechanism, so as to enhance the ability of relevant industries in our city to cope with international and domestic competition and form a good innovation culture.
Second, the work content of the intellectual property protection workstation
Industry associations independently set up intellectual property protection workstations according to the needs of the industry, and carry out but not limited to the following work:
(1) Publicity and training on intellectual property rights. Through intellectual property publicity and training, improve the awareness and skills of intellectual property protection of association members, give full play to the unique role of trade associations in the construction of soft environment such as technical exchange, personnel training, publicity and education, and promote information exchange and business cooperation within and between industries.
(2) Intellectual property business guidance. Provide information retrieval, legal advice, management norms and other business guidance for members to solve practical problems. Regularly collect the needs and difficulties of enterprise intellectual property protection, focus on unified research countermeasures and deal with foreign intellectual property risks.
(3) Intellectual property protection assistance. Establish a rapid resolution mechanism for intellectual property disputes and resolve intellectual property disputes in a timely manner through consultation and mediation. Establish an intellectual property protection assistance mechanism, relying on professional service organizations or leading enterprises to provide timely, professional and efficient intellectual property protection services for member enterprises to participate in domestic and foreign economic and trade activities, and help enterprises to "go global" smoothly.
(4) Other intellectual property work. Conditional workstations can also carry out patent analysis, early warning of rights protection and other work in this industry to improve the operation level and rights protection ability of intellectual property rights in this industry.
Third, support measures for intellectual property protection workstations.
(1) After the establishment of the intellectual property protection workstation, the trade association can report its establishment and work to our committee, and our committee will designate a special person to contact, provide necessary guidance and support for the problems encountered by the workstation, coordinate the cooperation between the market supervision bureau in the jurisdiction where the workstation is located and the workstation, and provide rights protection services for the members of the association.
(2) If the intellectual property protection workstation has been established and operated for more than one year, equipped with specialized staff and formed a relatively complete intellectual property protection system, and achieved certain results in promoting the creation, protection and application of intellectual property rights in this industry, it may apply for special funds for intellectual property protection of our commission. Those who meet the requirements and related processes will be given priority.
Professional institutions with public welfare nature and providing intellectual property public welfare services may set up intellectual property protection workstations with reference to this notice.
