1. If the price of illegally sold food is less than 1 10,000, a fine of 20,000 to 50,000 will be imposed; If the price is higher than 10000, a fine of more than 5 times the value of the goods or less than 10 will be imposed; If the circumstances are serious, the license shall be revoked: substances harmful to the health other than those specified are added to the food; Producing and selling foods that are harmful to human health; Foods whose ingredients do not meet the requirements.
2. Legal basis: Article 27 of People's Republic of China (PRC) Food Safety Law.
The national standards for food safety shall be formulated and promulgated by the health administrative department of the State Council in conjunction with the food safety supervision and administration department of the State Council, and the national standard number shall be provided by the standardization administrative department of the State Council. The limits of pesticide residues and veterinary drug residues in food, as well as the inspection methods and procedures, shall be formulated by the health administrative department of the State Council and the agricultural administrative department of the State Council jointly with the food safety supervision and administration department of the State Council. Rules for inspection of livestock and poultry slaughter shall be formulated by the administrative department of agriculture of the State Council in conjunction with the administrative department of health of the State Council.
Article 28
The formulation of national food safety standards should be based on the results of food safety risk assessment, fully consider the results of edible agricultural products safety risk assessment, refer to relevant international standards and international food safety risk assessment results, and publish the draft national food safety standards to the society, and listen to the opinions of food producers, operators, consumers and relevant departments. The national food safety standards shall be examined and approved by the National Food Safety Standards Review Committee organized by the health administrative department of the State Council. The National Standards Review Committee for Food Safety is composed of experts in medicine, agriculture, food, nutrition, biology and environment, and representatives from relevant departments, food industry associations and consumers' associations in the State Council to review the scientific and practical nature of the draft national standards for food safety.
2. What penalties will be imposed for failing to clean up expired food in time?
1, illegal production and operation of food and food additives, the value of which is less than 10,000 yuan, and a fine of 50,000 yuan to 100,000 yuan;
2, the value of more than ten thousand yuan, and impose a fine of ten times the value of more than twenty times;
3. If the circumstances are serious, the license shall be revoked.
