Notice on further standardizing the publicity and pre-sale notification of commercial housing sales information

In order to further standardize the sales behavior of commercial housing, protect the buyers' right to know and choose, reduce after-sales disputes and maintain the order of the real estate market, according to the Administrative Measures for the Pre-sale of Urban Commercial Housing (Order No.65438 of the Ministry of Construction +03 1), the Administrative Measures for the Sales of Commercial Housing (Order No.88 of the Ministry of Construction) and the Notice on Further Standardizing the Business Behavior of Real Estate Development Enterprises and Maintaining the Order of the Real Estate Market (J. [2066]

The first is to standardize the publicity of commercial housing sales information.

Real estate development enterprises or entrusted intermediaries to sell new commercial housing shall focus on publicizing and warning the following information in a prominent position in the commercial housing sales hall, and publicize the following contents on the website designated by the municipal and county housing and urban construction (housing management) departments.

1. Real estate development enterprise business license and real estate development qualification certificate, construction land planning permit, state-owned land use right certificate, construction project planning permit, construction project construction permit, and commercial housing pre-sale (sales) permit.

2. Commercial housing project planning general plan, building plan, building density, green rate, building spacing, building number, detailed floor plan of apartment type, buildings that have been approved for pre-sale (if the number of pre-sale buildings is inconsistent with the plan, special instructions shall be given), corresponding housing land use years, housing planning purposes, real estate surveying and mapping results report, supporting description of public buildings, underground parking space plan and civil air defense area plan, and parking space ratio.

3. When the land use right and the project under construction are mortgaged, the basic information of the mortgagee, the mortgage amount, the mortgage period and the proof materials that the mortgagee agrees to sell the mortgaged house shall be publicized.

4. The publicity form of commercial housing sales in Jiangxi Province (one room and one price list), which includes: the floor, orientation, room number, apartment type, construction area, interior area, pool area, sales price and effective time of each set of commercial housing.

5. Fine (complete) decoration of commercial housing needs to publicize the residential decoration price, the list of delivery standards for residential decoration, the evaluation report of decoration price, etc.

6. Salesperson information should be publicized at the sales site, including name, ID number, photo, employment certificate and work number. Intermediaries and employees who are not entrusted by real estate development enterprises shall not be included. If a real estate development enterprise entrusts a real estate intermediary to sell, it shall publicize the power of attorney for the sale of commercial housing and the scope and time limit of entrustment.

Second, standardize the pre-sale content of commercial housing.

Before signing the pre-sale contract of commercial housing, the real estate development enterprise or intermediary institution shall inform the purchaser of the following sales matters.

Three. Relevant requirements for information disclosure and notification.

1. The publicity period starts from the date of sale of the commercial house and ends on the date of complete sale. All publicity materials need to be stamped with the official seal of the real estate development enterprise.

2. The publicized sales information should be consistent with the online signing and filing information of commercial housing, and the publicized project name should be consistent with the approved pre-sale permit.

Publicity information and materials such as leaflets and promotional books shall be true, accurate and legal.

4. Do not publicize or inform the schools and kindergartens that have not enrolled students near the real estate; Do not publicize or inform airports, railway stations and subway stations that have not been built and operated, and do not deceive or mislead buyers.

5. The commercial housing sales information advertisement shall comply with the Anti-Unfair Competition Law of People's Republic of China (PRC), the Advertising Law of People's Republic of China (PRC) and the Regulations on the Publication of Real Estate Advertisements.

6. Real estate development enterprises and intermediaries should strengthen professional training for sales personnel to ensure that sales personnel are familiar with project planning and design, engineering construction, real estate market management, credit and tax policies, and it is strictly forbidden to mislead and make false propaganda that is inconsistent with the actual project or violates policies.

Fourth, strengthen the supervision of information publicity and pre-sale notification.

1. The departments of housing and urban-rural construction (housing management) in cities and counties should strengthen the supervision and guidance on the on-site sales of commercial housing, standardize the standards and methods of publicity, improve the publicity level and ensure the publicity effect.

2. The housing and urban construction (housing management) department of a city divided into districts regularly organizes inspections or unannounced visits to the sales site of real estate, and the housing and urban construction (housing management) department of a county (city, district) conducts on-site inspections to all the real estate for sale within its jurisdiction to ensure that the sales site is publicized and informed to meet the requirements.
