Measures for the Administration of Bidding Control Price
Article 1 In order to strengthen the supervision and management of the bidding control price of the bill of quantities of construction projects, maintain the normal order of the construction market, reasonably determine and effectively control the project cost, improve the investment benefit, ensure the quality and safety of construction projects, and safeguard the legitimate economic rights and interests of all parties involved in the project construction, these measures are formulated in accordance with the Regulations of Gansu Province on the Administration of Construction Project Cost and relevant regulations, and combined with the actual situation of this province.
Article 2 These Measures shall be applicable to the construction projects subject to tender by bill of quantities within the territory of this province.
Article 3 The term "tender control price" as mentioned in these Measures refers to the highest price limit of a project determined by a tenderee who has obtained the qualification of engineering cost practice or a qualified engineering cost consulting institution entrusted by the tenderee, according to the pricing basis, pricing method and related pricing regulations issued by the national or provincial, municipal (state) construction administrative department, combined with the actual situation of the project and the market situation.
Fourth provincial construction project cost management institutions are specifically responsible for the supervision and management of the bidding control price of construction projects in the province. Municipalities (States) construction project cost management agencies are responsible for the specific work of bidding control price management of construction projects in the region.
Article 5 Basis for compilation of tender control price:
(a) "Gansu province construction engineering bill of quantities valuation management measures" and "Gansu province construction engineering bill of quantities valuation rules";
(two) the valuation basis and valuation method of construction projects in this province;
(3) Design documents and relevant materials of the construction project;
(four) the relevant requirements, bill of quantities and supplementary documents in the tender documents;
(5) Technical data such as standards and specifications related to construction projects;
(six) the budget price, guidance price or market price information issued by the project cost management institution of this province;
(7) Other relevant information.
Article 6 The tender control price shall be published on the designated media such as the information network of Gansu Provincial Construction Department 7 days before the bid opening. At the same time, the name, address and contact information of the preparer shall be announced.
The tenderer shall, at the same time of publishing the tender control price, submit the complete tender control price achievement document to the provincial, municipal (state) engineering cost management institution and the tender supervision institution for future reference.
Article 7 The reference documents of tender control price shall be in written form and electronic text form, and their contents and formats shall be consistent. The bidding control price achievement document shall be uniformly used by the engineering cost valuation software approved by the provincial construction administrative department.
Article 8 When compiling the tender control price and the bidder's bid quotation, the tenderer shall calculate the social security fee and housing accumulation fund in the project fee subject to tender according to the rate standard stipulated in the Gansu Province Construction and Installation Project Cost Quota (Table 5-8), and include them in the tender control price and bid quotation.
When signing the construction contract, the tenderer and the winning bidder must clearly stipulate that the social security fee and housing accumulation fund shall be adjusted according to the standards approved by the Gansu Provincial Construction Project Cost Standard Certificate when the project is settled.
Article 9 A bidder shall, in any of the following circumstances, complain to the project cost management institution and the bidding supervision institution at the same time five days before the bid opening.
(a) the entrusted engineering cost consulting institution does not have the qualification of engineering cost consulting enterprise or exceeds the qualification scope;
(2) intentionally raising or lowering the tender control price;
(three) does not meet the relevant provisions of the state and province.
Tenth projects approved by the state and the province, by the provincial construction project cost management station and the provincial construction project bidding management office is responsible for accepting and handling the bidding control price complaints.
City (state), county (city, district) approved the project subject to tender, by the city (state) project cost management institutions and bidding supervision institutions responsible for accepting and handling complaints about the bidding control price.
Article 11 When making a complaint, a complainant shall submit a complaint. The complaint must have the official seal of the unit and the signature or seal of the legal representative or his client. The complaint shall include the following contents:
(1) The name, address and contact information of the complainant;
(2) The name, address and contact information of the respondent;
(3) the reasons for the complaint;
(four) the relevant certification materials of the complaint.
Twelfth the complainant is responsible for the authenticity of the complaint, and shall not slander other parties in the name of the complaint, and shall not make false or malicious complaints, which will hinder the normal bidding activities.
Thirteenth engineering cost management institutions after receiving a complaint, not to meet the conditions of the complaint will not be accepted, and will not accept the reasons to inform the complainant in writing. Those that meet the acceptance conditions shall be accepted. Inform the bidding supervision institution of the complaint in writing, and the bidding supervision institution will inform the tenderer to immediately suspend the bidding activities of the complained project until the conclusion of complaint handling is informed.
Article 14 A complaint shall not be accepted under any of the following circumstances:
(a) the complainant is not a bidder of the project subject to complaint;
(two) the time for submitting the complaint is not in conformity with the provisions of Article 9 of these Measures;
(three) the complaint does not conform to the provisions of article eleventh of these measures;
(four) the complaint is not specific, and the supporting materials provided are false or incomplete.
Fifteenth engineering cost management agencies received complaints about the project bidding control price, should be promptly designated engineering cost consulting enterprises for review. The engineering cost consulting enterprise shall complete the review within 5 working days (which may be extended appropriately under special circumstances), make a written review report and submit it to the engineering cost management institution in time. After confirmation by the project cost management organization, the bidding supervision organization will inform the tenderee of the complaint handling conclusion, and the tenderee will re-announce the bidding control price.
Complaints should be resolved within 7 working days after acceptance. Large and medium-sized projects may be appropriately postponed, but the complainant and the respondent shall be informed of the time when the conclusion of complaint handling is made. If the deadline for bidding is postponed due to complaint handling, the deadline for bidding shall be postponed.
Article 16 The engineering cost consulting enterprise shall organize relevant professionals to review the bidding control price according to the relevant provisions of the bill of quantities valuation of construction projects in our province, as well as relevant information such as construction project design documents, bidding documents, bidding questions and answers, bidding addendum, bidding control price calculation book, etc.
Seventeenth examination fees shall be calculated and prepaid by the applicant in accordance with the relevant project cost consulting fees and standards in our province. After review, it is confirmed that the error range of bidding control price is within 3% (including 3%), and the review fee shall be borne by the applicant; If the error range exceeds the above provisions, the review fee shall be borne by the tenderee or its authorized preparer. At the same time, if it is confirmed by review that the error range of bidding control price is beyond the specified range, the project cost achievement document will be recorded as a bad record in the integrity file of the project cost preparation unit and project cost professionals.
Eighteenth the provisions of this province in the past on the management of bidding control price are inconsistent with these measures, and these measures shall prevail.
Nineteenth these Measures shall come into force as of the date of issuance.
