Opinions of the Ministry of Housing and Urban-Rural Development on Promoting the Transformation, Upgrading, Innovation and Development of Engineering Supervision Industry?

The establishment and implementation of construction project supervision system has promoted the socialization and specialization of construction organization and implementation mode, provided an important guarantee for project quality and safety, and is an important reform measure and achievement in the field of engineering construction in China. In order to implement the spirit of the Central City Work Conference and the Opinions of the General Office of the State Council on Promoting the Sustainable and Healthy Development of the Construction Industry (Guo Ban Fa [20 17] 19), improve the project supervision system, give full play to the supervision role, and promote the transformation, upgrading and innovative development of the project supervision industry, we hereby put forward the following opinions:

I. Main objectives

The diversified level of engineering supervision services has been significantly improved, the service model has been effectively innovated, and a market system of engineering supervision services based on marketization, internationalization and informatization has gradually formed. The industrial organization structure is more optimized, forming an industrial layout with enterprises mainly engaged in construction site supervision services as the main body, comprehensive enterprises providing whole-process engineering consulting services as the backbone, and various engineering supervision enterprises with reasonable division of labor, orderly competition and coordinated development. The core competitiveness of the supervision industry has been significantly enhanced, and a number of large-scale engineering construction consulting service enterprises with intelligence-intensive, technology-complex and management-intensive have been cultivated.

Second, the main task

(a) to promote supervision enterprises to perform their duties according to law. Engineering supervision enterprises shall, according to the entrustment of the construction unit, objectively and fairly carry out the supervision tasks, and supervise the contractors in accordance with laws, administrative regulations, relevant technical standards, design documents and the provisions of the construction project contract. The construction unit shall, in strict accordance with the requirements of relevant laws and regulations, select qualified supervision enterprises, pay the supervision fees in full and on time in accordance with the entrustment contract, authorize and support the supervision enterprises to carry out supervision work, and give full play to the supervision role. The construction unit should actively cooperate with the supervision enterprise and obey the supervision and management of the supervision enterprise.

(two) to guide the diversification of service subjects of supervision enterprises. Encourage and support supervision enterprises to provide entrusted services for construction units, further expand the scope of service subjects, and actively provide professional services for all parties in the market. In order to meet the requirements of the government to strengthen the management of engineering quality and safety, according to the way of government purchasing social services, entrusted by the government quality and safety supervision institutions, the key links and key parts of the project are inspected for engineering quality and safety. To adapt to the requirements of implementing the engineering quality insurance system, accept the entrustment of insurance institutions, and carry out risk analysis and evaluation and quality and safety inspection in the construction process.

(C) innovative engineering supervision service model. Encourage supervision enterprises to expand their service fields to the upstream and downstream on the basis of supervision in the construction stage, and provide diversified "menu" consulting services such as engineering consulting, bidding agency, cost consulting, project management and on-site supervision. There is no need to entrust supervision to select enterprises with corresponding engineering supervision qualifications to carry out whole-process engineering consulting services. In order to meet the reform requirements of giving full play to the leading role of architects, combined with conditional construction projects, a new management model of architect team guiding and supervising construction quality is tried out, and on-site quality and technical supervision is entrusted by architects. Encourage supervision enterprises to actively explore the content and mode of consulting services under new financing methods such as government and social capital cooperation (PPP).

(D) Improve the core competitiveness of supervision enterprises. Guide supervision enterprises to increase investment in science and technology, adopt advanced detection tools and information means, innovate engineering supervision technology, management, organization and process, and improve engineering supervision service ability and level. Encourage large-scale supervision enterprises to develop whole-process engineering consulting by means of cross-industry and cross-regional joint operation, merger and reorganization, and cultivate a number of whole-process engineering consulting enterprises with international standards. Support small and medium-sized supervision enterprises and supervision firms to further improve their technical level and service level, and provide characteristic and professional supervision services for the market. Promote the application of building information model (bim) in engineering supervision service, and constantly improve the informatization level of engineering supervision. Encourage engineering supervision enterprises to seize the strategic opportunity of the "Belt and Road" countries, actively participate in international market competition, and enhance international competitiveness.

(5) Optimize the market environment of engineering supervision. Accelerate the reform of the administrative examination and approval system with the core of simplifying enterprise qualification category and grade setting and strengthening individual practice qualification, promote the moderate separation of enterprise qualification standards and registered practitioners, improve the signature system of registered supervision engineers, strengthen the implementation of registered supervision engineers' practice responsibilities, and promote the establishment of supervision engineers' personal practice liability insurance system. Accelerate the construction of credit mechanism in the supervision industry, improve the information collection and application of enterprises, personnel, projects and credit behavior databases, establish a blacklist system, and disclose the credit records of enterprises and individuals according to laws and regulations.

(six) to strengthen the supervision of engineering supervision. If an engineering supervision enterprise finds that the hidden danger of safety accidents is serious and the construction unit refuses to rectify or stop construction, it shall report to the competent government department in time. Carry out the pilot project of quality supervision in which supervision enterprises report to the government, and establish and improve the supervision and reporting system. Establish an electronic review and dynamic verification system for enterprise qualifications and personnel qualifications, increase supervision and inspection of the performance of duties of on-site personnel in key monitoring enterprises, and timely discover illegal enterprises and employees. In violation of the relevant provisions, resulting in quality and safety accidents, the responsible supervision enterprises shall be given administrative penalties such as suspension of business for rectification, reduction of qualification grade and revocation of qualification certificate, and the responsible registered supervision engineers shall be given penalties such as suspension of practice, revocation of qualification certificate, a certain period of time or lifelong non-registration.

(7) Give full play to the role of trade associations. Supervision industry associations should strengthen their own construction, improve the industry self-discipline mechanism, enhance the ability to serve supervision enterprises and employees, and earnestly safeguard the legitimate rights and interests of supervision enterprises and employees. Encourage supervision industry associations at all levels to carry out in-depth investigation and research around supervision service cost, service quality, market supply and demand, and carry out the collection and release of engineering supervision service price information to promote fair competition. Supervise trade associations to reflect the demands of enterprises to the competent government departments in a timely manner, feedback the implementation of policies, and make suggestions for relevant government departments to formulate laws, regulations, policies, industry development plans and standards.

Third, organize the implementation.

(1) Strengthen organizational leadership. The competent departments of housing and urban construction at all levels should fully understand the importance of the reform and development of the engineering supervision industry, formulate local reform implementation plans according to local conditions according to the overall deployment of the reform, refine policies and measures, and promote the deepening of the reform of the engineering supervision industry.

(2) Actively carry out pilot projects. Adhere to the pilot first, mode leading, all localities should actively carry out the pilot work of cultivating the whole process of engineering consulting services and promoting the diversification of supervision service subjects on the basis of investigation and research, combined with the actual situation in the region. It is necessary to track the progress of the pilot in time, study and solve the problems found in the pilot, sum up experience, improve the system, and promote it in a timely manner.

(3) create an atmosphere of public opinion. Comprehensively and accurately evaluate the project supervision system, vigorously publicize the significance of the reform and development of the project supervision industry, carry out typical publicity and promotion of the industry, strengthen public opinion supervision at the same time, increase the exposure of illegal acts, and form a public opinion environment conducive to the reform and development of the project supervision industry.
