The supplier may or may not be a manufacturer, mainly depending on whether the product is produced by the supplier. A manufacturer is either a producer or a supplier of products.
According to Article 3 of the Measures for the Administration of Fair Trade between Retailers and Suppliers
The term "retailer" as mentioned in these Measures refers to enterprises and their branches registered in the administrative department for industry and commerce according to law and selling goods directly to consumers, with annual sales (including chain store sales for enterprises engaged in chain operation) of more than 6,543,800 yuan.
The term "supplier" as mentioned in these Measures refers to enterprises and their branches and individual industrial and commercial households that directly provide goods and corresponding services to retailers, including manufacturers, distributors and other intermediaries.

According to Article 5 of the Measures for the Administration of Fair Trade between Retailers and Suppliers
Retailers and suppliers are encouraged to adopt the model contract text recommended by the competent commerce department and the administrative department for industry and commerce in their transactions.
Article 6 Retailers shall not abuse their dominant market position to engage in the following unfair trading behaviors:
(1) After signing a supply contract for a specific commodity with a supplier, both parties reach an agreement on the specific specifications, models and styles of the commodity, and then refuse to accept the commodity. However, there are reasons attributable to the supplier, or with the consent of the supplier, the retailer is responsible for the resulting losses;
(two) require suppliers to bear the responsibility for the loss of goods that have not been agreed in advance;
(3) The retailer removes the goods supplied by the supplier from the shelves or cabinets without justifiable reasons because it has not agreed or failed to meet the pre-agreed conditions for removing the goods from the shelves or cabinets; However, unless the retailer removes the goods supplied by the supplier from the shelves or cabinets according to laws and regulations or administrative decisions made by administrative organs according to law;
(4) Forcing suppliers to unconditionally sell rebates, or agreeing to take a certain amount of sales as the premise of sales rebates, but failing to complete the agreed sales, and collecting rebates from suppliers;
(five) forcing suppliers to buy designated goods or accept designated services.
