Regulations of Hami Municipality on the Protection of Water Resources

Chapter I General Provisions Article 1 In order to strengthen the protection and management of water resources, promote the construction of water ecological civilization, and promote the coordination between economic and social development and the carrying capacity of water resources and water environment, these Regulations are formulated in accordance with the Water Law of People's Republic of China (PRC), the Law on the Prevention and Control of Water Pollution of People's Republic of China (PRC), the Regulations on the Management of Groundwater Resources in Xinjiang Uygur Autonomous Region and other relevant laws and regulations. Article 2 These Regulations shall apply to the conservation, protection, development and utilization of water resources and related management activities within the administrative area of this Municipality. Article 3 The conservation, protection, development, utilization and management of water resources shall follow the principles of giving priority to conservation, spatial balance, systematic management and paying attention to both, and adhere to the principles of unified management, scientific planning, overall consideration, comprehensive utilization and attention to ecology, so as to comprehensively protect surface water and groundwater.

Soldiers and local governments implement unified protection and management of water resources, and establish and improve mechanisms for communication and coordination, joint inspections and supervision and inspection of water resources. Article 4 The municipal and district (county) people's governments shall incorporate water resources protection into the national economic and social development plan, incorporate water resources protection funds into the annual budget, establish relevant water resources protection systems, implement the strictest water resources management, and promote the construction of a water-saving society.

Township people's governments, neighborhood offices and park management committees shall, in accordance with the requirements of the people's governments at higher levels and relevant administrative departments, do a good job in the protection and management of water resources.

Rivers, lakes and reservoirs within the administrative area of this Municipality shall implement the responsibility system of river length. Fifth city, district (county) water administrative department is responsible for the unified management and supervision of water resources within their respective administrative areas.

The administrative departments of ecological environment, development and reform, industry and informatization, finance, natural resources, housing and urban and rural construction, agriculture and rural areas, health and health are responsible for the protection and management of water resources according to their respective responsibilities. Article 6 The municipal, district (county) people's governments and their relevant departments and news media shall strengthen publicity and education on water resources protection, popularize the knowledge of laws and regulations on water resources protection, and improve the public's awareness and ability to participate in water resources protection. Article 7 All units and individuals have the obligation to protect and save water resources according to law, and have the right to stop, report and accuse acts of destroying and polluting water resources. Chapter II Water Resources Planning Article 8 The municipal, district (county) water administrative department shall, jointly with the development and reform departments and other relevant departments, formulate a comprehensive water resources plan for its administrative region, submit it to the people's government at the same level for approval, and report it to the water administrative department at the next higher level for the record.

In the preparation of national economic and social development planning, urban master planning, industrial park planning, agriculture, animal husbandry and other industrial development planning and the layout of major construction projects, we should adhere to the principle that the total water demand and water consumption are compatible with water resources planning. Article 9 When formulating industrial policies and investment project plans, the administrative departments in charge of development and reform, industry and information technology shall comprehensively consider local water resources conditions and water pollution prevention and control requirements, and strictly limit projects with high water consumption.

The relevant administrative departments of the city, district (county) shall solicit the opinions of the water administrative department at the same level when preparing the special plan for water resources. Article 10 When allocating water resources, the municipal, district (county) people's governments shall strictly follow the comprehensive planning and professional planning of water resources, control the total amount of water used, give priority to ensuring the domestic water for urban and rural residents, meet the agricultural irrigation water for the second round of contracted land, and rationally allocate the development of secondary and tertiary industries and ecological water.

Establish and improve the water rights system, improve the water price formation mechanism, encourage and guide units and individuals to carry out water rights transactions. Eleventh development and utilization of water resources should maintain the reasonable ecological water demand of wetlands, lakes and public welfare forests, give priority to the allocation of surface water, and strictly control the exploitation of groundwater. It is forbidden to add new agricultural water and soil development projects.

Unconventional water resources should be given priority in new industrial projects. The water resources transferred from outside the region are mainly used for new industrialization and urbanization.

Encourage the use of reclaimed water. Chapter III Protection of Water Resources Article 12 The municipal, district (county) people's governments shall strengthen the protection of the East Tianshan Mountains, glaciers, rivers, lakes, groundwater, wetlands and natural vegetation in Hami, maintain a reasonable amount of water in rivers and a reasonable water level in lakes and groundwater, and maintain the natural purification capacity of water bodies. Thirteenth city, district (county) people's government shall prepare the ecological restoration and protection plan of Hami East Tianshan Mountain, clarify the specific measures and objectives, and organize their implementation. Fourteenth city, district (county) people's government should strengthen the protection and monitoring of glaciers, and delimit the scope of glacier protection. The following acts are prohibited within the scope of glacier protection:

Grazing, logging, hunting or breeding;

(2) Traveling or exploring;

(3) Mining, quarrying, dredging, blasting or excavating wild plants;

(four) other acts that affect glaciers. Fifteenth city, district (county) people's government shall delimit the water function zones of rivers and lakes in the region and set up signs. No unit or individual may make adjustments without authorization. Article 16 The municipal, district (county) people's governments shall establish a drinking water source safety assessment system and a drinking water source quality monitoring and early warning system, formulate an emergency plan for drinking water sources, build emergency water sources or standby water source projects, and ensure the safety of urban and rural water supply.

Urban and rural drinking water or emergency water intake is affected due to war preparedness, drought, fire and earthquake. , need to enable emergency electromechanical wells, shall be approved by the original examination and approval authority; If emergency electromechanical wells are used in severely over-exploited areas, they shall be approved by the municipal water administrative department.
