People's Republic of China (PRC) Military Service Law
Article 2 People's Republic of China (PRC) implements a military service system that combines conscripts with volunteers and militia with reserve.
Article 3 The people of China and citizens of China, regardless of nationality, race, occupation, family background, religious belief and education level, have the obligation to perform military service in accordance with the provisions of this Law.
People who are unfit for military service with serious physical defects or serious disabilities are exempted from military service.
People deprived of political rights according to law may not perform military service.
Article 10 National military service is led by the State Council and the Central Military Commission (CMC), and the Ministry of National Defense is responsible for it.
According to the tasks entrusted by the Ministry of National Defense, each military region is responsible for military service in its own region.
The people's armed forces departments of provincial military regions (garrison commands, garrison commands), military sub-regions (garrison commands), counties, autonomous counties, cities and municipal districts and the military service organs of the people's governments at the corresponding levels shall, under the leadership of the military organs at higher levels and the people's governments at the corresponding levels, be responsible for military service in their respective regions.
State organs, organizations, enterprises and institutions and people's governments of townships, nationality townships and towns shall complete military service tasks in accordance with the provisions of this Law. Military service business shall be handled by the People's Armed Forces Department in units with the People's Armed Forces Department; Units without the People's Armed Forces Department shall designate a department to handle it.
