According to the provisions of Article 2 of the Administrative Measures for the Extraction and Use of Safety Production Expenses of Enterprises, these Measures shall apply to enterprises and other economic organizations (hereinafter referred to as enterprises) directly engaged in coal production, non-coal mine mining, construction, production and storage of dangerous goods, transportation, fireworks production, metallurgy, machinery manufacturing, development, production and testing of weapons and equipment (including civil aviation and nuclear fuel) in People's Republic of China (PRC).
Article 4 The meanings of the following terms in these Measures are:
Coal production refers to activities related to the development of coal resources. Non-coal mining refers to the exploration, production, beneficiation, pit closure and tailings operation and storage closure of mineral resources such as oil and gas, coalbed methane (open pit mining), metal mines and non-metal mines.
Construction engineering refers to civil engineering, construction engineering, shaft engineering, installation and decoration engineering of lines, pipelines and equipment for new construction, expansion, reconstruction and mine construction. Dangerous goods refer to the articles listed in the List of Dangerous Goods (GB 12268) and the Catalogue of Dangerous Chemicals. Fireworks and firecrackers refer to fireworks and firecrackers products and civil black powder, pyrotechnics, fuses and other items used to produce fireworks and firecrackers.
Transportation includes road transportation, waterway transportation, railway transportation and pipeline transportation. Road transport refers to the transport of passengers and goods by motor vehicles; Waterway transportation refers to the transportation of passengers and goods by means of transport ships, port loading and unloading, and stockpiling; Railway transportation refers to the transportation of passengers and goods by train (including high-speed rail and intercity railway); Pipeline transportation refers to the transportation of liquid and gas substances with pipelines as tools.
Metallurgy refers to the activities related to the smelting and rolling of metal minerals, including the smelting and processing of ferrous metals, nonferrous metals and gold, as well as the production of auxiliary processes such as carbon and refractory materials that match the main process. Mechanical manufacturing refers to the manufacturing activities of various power machinery, metallurgical mining machinery, transportation machinery, agricultural machinery, tools, instruments, meters, special equipment, large and medium-sized ships, petroleum refining equipment and other mechanical equipment. Development, production and testing of weapons and equipment, including scientific research, production, testing, storage and transportation, destruction and maintenance of weapons and ammunition.

Measures for the administration of the extraction and use of safety production expenses of enterprises Article 32 An enterprise shall strengthen the management of safety expenses, prepare an annual plan for the extraction and use of safety expenses, and incorporate it into its financial budget. The use plan of the annual safety expenses of an enterprise and the extraction and use of the safety expenses of the previous year shall be reported to the financial department at the same level, the supervision and administration department of production safety, the coal mine safety supervision institution and the competent department of industry for the record in accordance with the management authority.
Article 36 If an enterprise fails to extract and use safety expenses in accordance with these Measures, the safety production supervision and management department, the coal mine safety supervision institution and the competent department of industry shall, jointly with the financial department, order it to make corrections within a time limit and deal with and punish it in accordance with relevant laws and regulations.
If the general contractor of a construction project fails to pay the necessary safety expenses to the subcontractors, and the contractor misappropriates the safety expenses, the competent departments of construction, transportation, railways, water conservancy, production safety supervision and management, coal mine safety supervision, etc. shall deal with it and punish it in accordance with relevant laws and regulations.
