Can a house without acceptance be renovated in advance?

Under normal circumstances, after the commercial housing is completed and accepted, the developer will inform the buyers to go through the check-in procedures, and the buyers will be deemed to have delivered the house after receiving the house key and accepting the house. In fact, some property buyers often decorate their houses in advance before they are completed and accepted. Of course, there are developers in disguised form to encourage, but also property buyers voluntary requirements. However, this kind of early decoration has great legal risks.

First of all, there is a risk that the developer can't get the completion acceptance on schedule in advance. Although, in most cases, the main project has been basically completed, the completion acceptance of the project includes many aspects, including both the quality of the main project of the house and the comprehensive acceptance of fire protection, gas and elevators.

Secondly, there is a risk that the pre-renovation can't get liquidated damages for delayed delivery. According to Article 11 of the Supreme People's Court's Interpretation on Several Issues Concerning the Application of Law in the Trial of Disputes over Commercial Housing Sales Contracts, when the commercial housing is delivered, if the buyer directly occupies and uses the house, it will be deemed as delivery. Commonly known as "turnkey". In judicial practice, the buyer's early decoration behavior is regarded as delivery, that is, the change of the delivery conditions of the house agreed by the buyer and the developer in the contract. Even if the developer delays the delivery of the house in the future, the buyers have no right to claim compensation.

In addition, there are housing quality risks in early decoration. In the case that the housing project has not been completed and accepted, there are many uncertain factors in the acceptance of the house by buyers, and it is impossible to determine whether there are quality problems in the house. Once decorated, some quality problems can be hidden, and it will take some time to show up, especially some hidden projects. At the same time, it is difficult to determine the responsibility of some quality problems, whether it is decoration problems or their own housing quality problems, without the developer providing the house quality guarantee and the house use manual to the buyers, which has brought unnecessary trouble to the buyers.

Therefore, buyers should avoid fluky psychology, do not "hurry", and must carefully inspect the house before renovation, so as to avoid legal risks when the developer has obtained the completion acceptance record and provided the Residential Quality Guarantee and the Residential Instruction Manual.
