Shaoxing yellow rice wine as mentioned in these Regulations refers to the geographical indication product Shaoxing wine and other yellow rice wine that is originated and rooted in Shaoxing and produced by traditional brewing technology within the administrative area of this Municipality after historical inheritance and development. Article 3 The Municipal People's Government shall strengthen leadership, formulate the protection and development plan of Shaoxing yellow rice wine, organize the formulation and implementation of relevant policies and measures, establish an overall coordination mechanism, improve the standardization system of Shaoxing yellow rice wine, strengthen intellectual property protection, and promote the revitalization of Shaoxing yellow rice wine industry.
The competent department of economy and information technology is responsible for the overall coordination and organization of Shaoxing rice wine protection and development, and guides the work of Shaoxing rice wine industry association. Relevant departments such as ecological environment, culture and tourism, market supervision and management shall do corresponding work according to their respective responsibilities. Article 4 Shaoxing Yellow Rice Wine Industry Association shall assist the administrative department in formulating the industry development strategy and planning, organize and implement the overall publicity and brand building of the industry and products, formulate the industry code of conduct, guide its members to exercise self-discipline, safeguard their rights and interests, and serve the development of Shaoxing yellow rice wine industry. Fifth Shaoxing rice wine production enterprises and operators should strengthen self-discipline, integrity management, integrity innovation, and expand the influence of Shaoxing rice wine. Chapter II Protection and Inheritance Article 6 Shaoxing yellow rice wine should be brewed through the main technological processes such as soaking rice, steaming rice, pre-fermentation, post-fermentation, squeezing, frying wine and aging. Traditional hand-brewed Shaoxing yellow rice wine should also keep raw wheat koji as saccharifying agent, drenched rice koji as fermenting agent and ferment at low temperature.
The geographical indication product Shaoxing wine should take high-quality glutinous rice, wheat and Jianhu water as the main raw materials, which meets the relevant requirements of the national standard for geographical indication product Shaoxing wine. Article 7 The Municipal People's Government shall establish a list of Shaoxing yellow rice wine historical and cultural protection. The State Council, provincial and municipal people's governments have approved the publication of protected objects, directly included in the protection list.
The following historical and cultural resources related to the history and culture of Shaoxing rice wine can be included in the protection list after application and publication to the public:
(a) old workshops, wine storage places, ancient sites and other buildings (structures) reflecting the traditional brewing technology;
(two) the production, management and drinking of yellow rice wine with historical and cultural value;
(3) Traditional brewing technology, production technology and its representatives;
(4) Folklore and etiquette, as well as documents, manuscripts, video materials, etc. Reflect the history and culture of Shaoxing yellow rice wine;
(five) other historical and cultural resources of Shaoxing rice wine that need to be protected.
The municipal cultural tourism department shall, jointly with relevant departments, formulate listing procedures, management systems and specific protective measures, which shall be implemented after being approved by the Municipal People's Government. Article 8 The people's governments of cities and counties (cities, districts) shall support the representative inheritors and representative inheritors of Shaoxing yellow wine brewing techniques and other intangible cultural heritage projects to carry out inheritance activities.
Encourage the units responsible for the protection of Shaoxing yellow wine brewing technology and other intangible cultural heritage representative projects and inheritance base organizations to carry out normalized inheritance training and skills practice teaching activities, cultivate inheritance talents and lay a solid foundation for inheritance. Article 9 Shaoxing wine production enterprises that have obtained the right to use special geographical indications according to law shall organize production in accordance with corresponding standards and management norms, and mark special geographical indications on their products. Article 10 Shaoxing rice wine production enterprises may apply to Shaoxing Rice Wine Industry Association, the registrant of the certification trademark, for the use of the certification trademark. In line with the conditions, Shaoxing Yellow Rice Wine Industry Association shall license its use according to law and issue a trademark use certificate.
The user of the certification trademark shall use the certification trademark completely in strict accordance with the management rules and other provisions, and prominently mark and indicate the trademark registration mark in the obvious position of the product packaging.
Shaoxing rice wine production enterprises approved to use certification trademarks do not meet the conditions for the use of certification trademarks, and Shaoxing rice wine industry association shall handle them in accordance with the management rules for the use of certification trademarks. Eleventh Shaoxing rice wine production enterprises and operators should strengthen independent innovation, apply for registered trademarks and patents in accordance with the law, carry out copyright registration and intellectual property customs protection for the record, take reasonable measures to protect trade secrets and safeguard their legitimate rights and interests. Article 12 The Municipal People's Government shall establish an environmental protection zone for Shaoxing yellow rice wine production focusing on the protection scope of geographical indication product Shaoxing wine, establish a management system for the water used for the brewing of geographical indication product Shaoxing wine, and implement corresponding protection measures to ensure the water quality of Jianhu waters. Thirteenth Shaoxing rice wine production enterprises should organize production in accordance with their publicly implemented standards. Shaoxing rice wine industry association and Shaoxing rice wine production enterprises are encouraged to formulate and implement group standards and enterprise standards with advanced international and domestic levels.
Support Shaoxing rice wine production enterprises to establish high-quality glutinous rice and wheat planting bases, improve Shaoxing rice wine food safety traceability system, and ensure product quality and safety.
