Provisions of Tianjin Municipality on Education Supervision

Article 1 These Provisions are formulated in accordance with the Education Law of the People's Republic of China and other relevant laws and regulations, combined with the actual situation of this Municipality, in order to strengthen the administrative supervision of education, ensure the implementation of educational laws, regulations and rules, realize educational objectives and promote the healthy development of education in this Municipality. Article 2 The term "educational supervision" as mentioned in these Provisions refers to the administrative supervision system in which the municipal, district and county people's governments supervise, inspect, evaluate and guide the educational work within their respective jurisdictions according to law. Article 3 The scope of educational supervision is all kinds of education and related work at the secondary level and below in this Municipality.

Authorized by the people's government at the same level, it may also supervise the educational work other than that specified in the preceding paragraph. Article 4 The objects of educational supervision are the relevant administrative departments of the people's government at the same level, the people's governments at lower levels and their relevant administrative departments, schools at all levels below the secondary level, other educational and teaching institutions and their sponsors. Fifth education supervision must be based on the relevant education laws, regulations, rules and policies, and adhere to the principle of seeking truth from facts, objectivity and fairness. Article 6 The educational supervision institutions of the municipal, district and county people's governments shall be established by the municipal, district and county people's governments in accordance with relevant regulations.

On behalf of the people's government at the corresponding level, the education supervision institutions of the municipal, district and county people's governments are responsible for the education supervision work within their respective jurisdictions, and accept the professional guidance of the higher education supervision institutions. Article 7 The main responsibilities of educational supervision institutions are:

(a) to supervise the implementation of relevant education laws, regulations, rules, principles and policies;

(two) to supervise the performance of educational duties by the relevant administrative departments of the people's government at the same level, the people's governments at lower levels and their relevant administrative departments, schools and other educational and teaching institutions;

(three) to supervise the education management, quality, direction and efficiency of schools and other educational and teaching institutions;

(four) to supervise the implementation, consolidation and improvement of compulsory education and literacy education for young people, and to monitor the development level of students in compulsory education;

(five) to supervise the implementation of quality education;

(six) in conjunction with the administrative department of education to organize and coordinate major education evaluation work;

(seven) to investigate and study major issues in education and put forward opinions and suggestions to the relevant departments;

(eight) to organize the training and further study of inspectors, and to carry out scientific and theoretical research on information exchange and educational supervision;

(nine) to handle other matters assigned by the people's government at the corresponding level.

The education supervision institutions of the Municipal People's Government shall be responsible for overall planning, organizing and implementing the education supervision work of the whole city, formulating the guiding documents and working systems of the education supervision of this Municipality, and guiding the work of the education supervision institutions of the district and county people's governments. Article 8 The municipal, district and county people's governments shall provide necessary working conditions and financial guarantee for educational supervision institutions. Ninth education supervision institutions should be equipped with inspectors and other staff according to their duties and tasks.

The term "inspector" as mentioned in the preceding paragraph refers to the personnel who perform the tasks and duties of educational supervision. Article 10 special inspector shall meet the following conditions:

(a) with a high political quality and theoretical level, familiar with the national laws, regulations, rules and policies on education;

(two) with a bachelor's degree or equivalent, generally should have more than seven years of education, education management experience and the ability to work independently;

(three) law-abiding, moral integrity, seeking truth from facts, adhere to principles, decent style, fair;

(four) received special training in education supervision and passed the examination;

(5) good health. Eleventh inspectors by the people's government at the same level in accordance with the relevant provisions of the appointment and removal.

The municipal, district and county people's governments may employ a corresponding number of part-time inspectors and invited inspectors according to the needs of their work. Part-time inspectors and invited inspectors enjoy the same authority as inspectors.

The qualification certificates of inspectors, part-time inspectors and invited inspectors shall be issued by the people's government at the corresponding level. Twelfth basic forms of educational supervision are comprehensive supervision, special supervision and random supervision.

The term "comprehensive supervision" as mentioned in the preceding paragraph refers to the comprehensive and systematic supervision activities of educational supervision institutions on the educational work of the supervised units.

Special supervision refers to the educational supervision institutions' individual or partial special supervision activities on the educational work of the supervised units.

Random supervision refers to the supervision activities such as going to the supervised unit from time to time to understand the situation, listen to opinions, check and guide the work according to the needs of the work. Thirteenth comprehensive supervision and special supervision in accordance with the following procedures:

(a) the educational supervision institutions determine the contents of educational supervision, formulate educational supervision plans and programs, and issue supervision notices to the supervised units in advance. The determination of the contents of major educational supervision shall be reported to the people's government at the corresponding level;

(two) the supervised unit shall conduct self-examination and self-assessment in accordance with the requirements of the notice, and submit the self-examination report and related materials;

(three) supervision and inspection or supervision and evaluation of the supervised units;

(four) to inform the supervised unit of the preliminary results of supervision and exchange views;

(five) issued a supervision result opinion to the supervised unit. Fourteenth education supervision institutions and inspectors can take the following ways to supervise:

(a) listen to the report;

(two) access to relevant documents, files and materials;

(three) to participate in relevant work meetings and organize symposiums;

(four) to carry out questionnaires, tests and individual interviews;

(five) to participate in education and teaching activities and other on-site investigations or inspections;

(six) to put forward suggestions on rewards and punishments for the work of the supervised unit and its main person in charge, and if necessary, to hand over the acts that violate the relevant national education laws, regulations and rules to the relevant departments for handling;

(seven) found that endanger the personal safety of teachers and students, violations of the legitimate rights and interests of teachers and students, disrupting the normal teaching order and other emergencies to be stopped, and instructed the competent departments and responsible units to deal with;

(eight) directly to the people's government at the same level and the higher people's government education supervision institutions to reflect the situation, put forward opinions and suggestions.
