Twentieth engineering cost consulting units shall undertake engineering cost consulting business within the scope approved by the qualification certificate.
It is forbidden to undertake engineering cost consulting business beyond the scope approved by the qualification grade and qualification certificate.
Twenty-first A and B engineering cost consulting units shall undertake business in accordance with the following provisions:
(1) The Grade A engineering cost consulting unit undertakes the engineering cost consulting business of various construction projects in China;
(2) Grade B engineering cost consulting units in provinces, autonomous regions and municipalities directly under the Central Government undertake engineering cost consulting services for small and medium-sized construction projects.
Article 22 When undertaking project cost consulting business across provinces, autonomous regions and municipalities directly under the Central Government, Grade A project cost consulting construction units shall go through the filing procedures with the construction administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government where the project is located.
Twenty-third government investment, state-owned units investment and government, state-owned enterprises and institutions investment holding construction projects, should be entrusted with the corresponding qualifications of domestic engineering cost consulting units for engineering cost consulting.
Twenty-fourth Sino-foreign joint ventures and construction projects using loans from foreign financial institutions shall, in principle, be undertaken by domestic first-class engineering cost consulting units; When it is really necessary for foreign engineering cost consulting units to participate, the Chinese side should be the mainstay and Sino-foreign cooperation should be adopted.
Twenty-fifth engineering cost consulting units to undertake engineering cost consulting business, should sign a project cost consulting contract with the entrusting unit. Engineering cost consulting contracts generally include the following main contents:
(1) The name and address of the party concerned;
(2) The name, entrusted contents, requirements and standards of the consulting project;
(3) Time limit for performance;
(four) consulting fees, payment methods and time;
(5) Liability for breach of contract and dispute settlement methods;
(6) Other contents agreed by the parties.
Twenty-sixth engineering cost consulting units shall indicate the grade and number of qualification certificates in the engineering cost achievement documents, and affix the official seal of the unit and the special seal for the practice of cost engineers.
Twenty-seventh project cost consulting unit fees in accordance with the relevant provisions of the state agreed in the project cost consulting contract. The parties shall not violate the provisions of the state on the minimum charge standard and arbitrarily lower the project cost consulting charge standard.
