Measures of Xining Municipality on the Administration of Green Buildings

Chapter I General Provisions Article 1 In order to further strengthen the management of green buildings, promote the transformation and upgrading of urban and rural construction, form a spatial pattern, industrial structure, production mode and lifestyle that saves resources and protects the environment, speed up the construction of a green development demonstration city, build a happy Xining and create a good environment to live in harmony with nature. According to "People's Republic of China (PRC) Energy Conservation Law", "Civil Building Energy Conservation Regulations" and "Qinghai Province Measures for Promoting the Development of Green Buildings", these measures are formulated in light of the actual situation of this Municipality. Article 2 These Measures shall apply to the planning, construction, operation and transformation of green buildings within the administrative area of this Municipality, as well as the supervision, management, guidance and encouragement of the development of green buildings.

The term "green building" as mentioned in these Measures refers to a building that saves energy, land, water and materials to the maximum extent, protects the environment and reduces pollution, provides people with healthy, applicable and efficient use space, and is in harmony with nature.

According to national regulations, green buildings are divided into three grades: one star, two stars and three stars. Article 3 The people's governments of cities and counties (districts) shall incorporate the development of green buildings into the national economic and social development plan, establish a joint meeting system of green buildings, and make overall plans and coordinate major issues concerning the development of green buildings. Article 4 The municipal administrative department of planning and construction shall be responsible for the organization, coordination, supervision and management of green buildings in the whole city, and organize the preparation of technical regulations for the design, construction, acceptance and evaluation of green buildings in this city according to relevant norms and standards.

County (District) planning and construction administrative departments shall be responsible for the promotion, application, supervision and management of green building technology within their respective jurisdictions.

Xining Economic and Technological Development Zone Park Management Committee and other administrative committees in the city should do a good job in the planning, construction, operation and transformation of green buildings in each park. Fifth municipal development and reform, economy and information technology, finance, science and technology, land and resources, housing security and real estate, water, environmental protection, urban management, statistics and other departments in accordance with their respective responsibilities, do a good job in the management of green buildings. Article 6 The Municipal People's Government shall incorporate the promotion of green building development into the assessment of green development, conduct objective assessment and evaluation on the completion of green building objectives and the implementation of implementation measures, and conduct annual assessment on the county (District) people's government and relevant departments. Article 7 The municipal and county (district) people's governments and their relevant departments shall strengthen publicity and education on the development of green buildings, encourage the public to actively participate in activities related to green buildings, promote comprehensive conservation and recycling of resources, implement nationwide water-saving actions, reduce energy consumption and material consumption, realize the circular link between production systems and living systems, and enhance the awareness of the whole people on resource conservation and environmental protection. Article 8 The municipal and county (district) planning and construction administrative departments shall do a good job in the collection, evaluation and identification of credit information of construction units, design units, construction drawing review institutions, construction enterprises, supervision units, energy efficiency evaluation institutions, real estate development enterprises and their employees, and incorporate the credit information into the credit system in the construction field, and implement the incentive of trustworthiness and punishment of dishonesty. Chapter II Planning and Project Establishment Article 9 The municipal administrative department of planning and construction shall, jointly with the municipal departments of development and reform, economy and informatization, land and resources, formulate a green building development plan and an annual implementation plan, which shall be implemented after being approved by the Municipal People's Government. Tenth city and county planning and construction administrative departments shall incorporate the development goals of green buildings into the overall planning, regulatory detailed planning and construction detailed planning of cities (towns), prepare special articles on green buildings, and clarify the requirements for green building grades. Eleventh city planning of key areas should be combined with the development of the region to determine the implementation objectives of green buildings, the preparation of green building planning in this region. Article 12 When compiling a project report (including a feasibility study report), the construction unit shall set up a special chapter for green buildings, which shall specify the requirements for green building grades, technologies selected for the project, investment benefits, energy conservation and emission reduction, and include the incremental cost of implementing green buildings in the investment estimation.

For newly-built office buildings and public buildings of state organs, the project construction unit shall incorporate the installation and operation costs of building energy itemized metering and data acquisition and transmission devices into the investment estimation. Thirteenth city, county (District) investment departments in the project, should be green building requirements into the energy-saving review of fixed assets investment projects, the project approval documents issued by the green building grade requirements should be stated. Fourteenth city and county planning and construction administrative departments in the release of state-owned construction land use rights transfer planning conditions, it should be clear about the requirements of green building grades and design points. Article 15 The municipal and county administrative departments of land and resources shall, according to the planning conditions for the assignment of the right to use state-owned construction land, incorporate the relevant requirements of green buildings into the assignment and disposal scheme of state-owned construction land, and publicize them in the announcement of assignment of the right to use state-owned construction land. In the land use right transfer contract signed with land users, the grade requirements of green buildings should be clearly defined. Sixteenth city and county planning and construction administrative departments in the issuance of land allocation project site submissions, it should be clear in the planning and design conditions of green building grade requirements and design points.

The administrative departments of land and resources of cities and counties shall, when signing the allocation decision, make clear the grade of green buildings according to the planning conditions.
