1. Party A and Party B shall abide by the national and local laws, regulations and provisions on safety in production and conscientiously implement the national, industrial and enterprise safety technical standards.
2. Under the unified leadership of Party A, set up a leading organization for safety production on the construction site, hold regular safety work meetings, establish and improve the responsibility system for safety production and the system of prevention and treatment by groups, formulate various safety production rules and regulations and safety production target responsibilities, form a complete safety production supervision and management system and guarantee system, and do a good job of implementation according to the division of responsibilities.
3. Adhere to the policy of "safety first, prevention first", and do not command or operate illegally. When organizing construction and production, we must first implement safety protection measures to prevent accidents.
4. Pay special attention to safety education, strict safety discipline, standardize safety behavior, purify the working environment, prohibit barbaric construction and prevent construction from disturbing people.
5. When an accident occurs, measures should be taken immediately to protect the scene, rescue the wounded and prevent the accident from expanding, and report to the superior in time to form an accident investigation team, find out the cause of the accident, identify the responsibility for the accident, formulate improvement measures according to the principle of "three-no-let-go", and put forward handling opinions for those responsible for the accident.
Three. Specific responsibilities of Party A
1. Party A is responsible for the safety management of the construction site. Organize and guide on-site safety production, announce to Party B the safety production rules and regulations of enterprises and construction sites, check Party B's safety production guarantee system and rules and regulations, and supervise and manage Party B's safety production.
2. When arranging Party B's work, according to its construction content and technological requirements, put forward construction methods and safety operation procedures, and provide necessary safety protection facilities. Make safety technical disclosure to the person in charge of Party B's construction in written form, and the disclosure shall be signed by the person in charge of Party A and Party B and the safety technical personnel for the record. Supervise Party B to follow the disclosure in the construction process.
3. Register Party B's on-site employees, re-examine their identity documents, issue badges, conduct "three-level" safety education according to the list, and establish safety education files. Review the qualifications of subcontractors' special operations personnel. Assist Party B to do a good job in training, assessment and management of certificates for special operators, and prevent non-special operators from engaging in special operations.
4. Provide a good working environment for Party B to ensure safe production. The electrical equipment, machinery, tools, erection equipment and safety protection articles provided must meet the safety technical standards. After Party B passes the acceptance, it shall go through the written handover and acceptance procedures in duplicate, one for each party, and Party B shall supervise the safe use.
5. Check the technical indexes and safety performance of Party B's own machines, tools, equipment and safety protection articles, and enter the construction site only after they are qualified. Supervise Party B's correct installation, use and removal.
6. Conduct daily supervision and inspection on the safety behavior of Party B's construction process and operation post, and correct the illegal command and operation. If serious violations of discipline and hidden dangers of accidents are found, they shall be ordered to stop work immediately, supervise the rectification and deal with them according to the management measures agreed by both parties. If the circumstances are serious, Party B shall terminate the contract and walk out, and all economic losses caused thereby shall be borne by Party B. ..
7. Regularly check and maintain various safety facilities and labor protection articles on the construction site, eliminate hidden dangers in time, and ensure their safety and effectiveness.
8. Provide employees' living environment that meets the requirements of hygiene, ventilation and lighting, and set up sensitive and effective fire-fighting equipment in fire-prone areas.
9. In case of casualty accident, immediately report to relevant departments according to regulations.
Four. Specific responsibilities of Party B
Under the unified command and supervision of Party A, Party B is directly responsible for the construction safety of this unit. According to the division of responsibilities, perform the following duties.
1. Accept the command and supervision of Party A, abide by Party A's safety management system, participate in the leadership organization of on-site safety production, attend the safety work meeting and implement the decisions of the meeting.
2. According to the unified management regulations of Party A, formulate the safety target responsibility and management rules and regulations of this unit, and file them with Party A. ..
3. The team's construction personnel shall register, truthfully report to Party A, and accept Party A's safety education. If there is any personnel change, it shall report to Party A in time and carry out safety education. Personnel without safety education are not allowed to enter the construction site, and personnel without identity documents or child labor are not allowed to be employed.
4. Responsible for pre-shift safety education and post change safety education. When assigning construction tasks, targeted safety technical disclosure should be conducted to check the safety dress of operators; If there is any crossover operation, it shall first report to Party A and monitor it. Non-special type of work personnel shall not be arranged to engage in special types of work, and personnel who are not suitable for working at heights such as hypertension and heart disease shall not be arranged to engage in working at heights.
5. Declare the labor protection articles and machines to Party A, and use them after passing the inspection. It is forbidden for anyone to dismantle safety protection equipment or facilities without permission.
6. When hot work is carried out in fire-prone areas, an application shall be submitted to Party A in advance, and the construction can only be started after obtaining written approval and taking effective protective measures. When storing and using inflammable and explosive equipment, special fire safety measures should be taken.
7. Educate the team members to obey the rules and discipline, and not to command or operate illegally. In the process of construction, if any casualty accident occurs due to Party B's construction personnel's illegal command, violation of discipline and violation of safety operation rules, Party B shall be responsible for the losses and Party A shall be responsible for compensation.
8. Party B shall carry out the construction in strict accordance with the requirements of Party A's safety technical disclosure, otherwise, any personal injury or death shall be borne by Party B. ..

Article 2 This Agreement is applicable to the construction, installation, renovation and renewal of civil engineering and fire protection systems; Safety production and civilized construction activities in the construction site of communication pipelines, communication lines and communication equipment installation projects.
Article 3 Party A has the right (not obligation or responsibility, the same below) to supervise the safety of Party B's construction site. The representative of Party A has the right to guide and supervise the safety management of the construction site. Party B must obey the management, supervision and inspection of Party A's representative, and relevant engineering units should actively cooperate to ensure the safety of the construction site.
Article 4 Party B must adhere to the safety management policy of safety first and prevention first in the construction site, pay attention to safe and civilized construction, and ensure the safety of telecommunication equipment, facilities and personnel.
Party B shall implement the relevant standards, norms and regulations of national, local and industrial authorities.
Party B must strictly abide by the following provisions during the construction:
(a) communication pipelines and lines on the construction site, should pay special attention to and comply with the following requirements.
1. Warning signs must be set up, with red flags during the day and red lights at night to attract the attention of pedestrians and various vehicles. Fences should be set up when necessary, and the traffic police should be invited to assist to ensure safety.
2. There are parallel and intersecting power cables in the construction area, and corresponding measures must be taken to avoid casualties.
3. When the construction personnel enter the CMC, they should first find out whether there are toxic or flammable gases in the CMC to avoid poisoning.
4. When working high above the ground, the construction personnel should first check the climbing tools and safety equipment to avoid falling accidents.
5. The erection height of the site construction power cord must meet the safety requirements; A red warning light must be installed.
(two) in the construction of communication room, we should pay special attention to and comply with the following requirements.
1. Measures must be taken to ensure the safety of operating equipment.
2. After unpacking the equipment, flammable sundries such as packing boxes should be removed from the site immediately.

4. If it is really necessary to enter the communication system during the construction period, you should go through the formalities of borrowing the password and return it immediately after use.
5. During the construction, lay cables, dismantle the fire plugs in the shaft and roadway, and re-plug them immediately after laying cables.
6. After the equipment is installed, it must be checked and tested by the supervisor, supervisor and electric power maintenance personnel before the power supply can be connected.
Article 5 The legal representative of the construction enterprise shall be responsible for production safety on the construction site, and the legal representative of Party B shall be responsible for the contract. The legal representative of Party B shall designate the project manager as the main person in charge of safety production management on the construction site.
All responsibilities, consequences and losses caused by damage to communication equipment and facilities, communication interruption and casualties shall be borne by Party B.. Due to Party B's construction and construction management.
Article 6 Party B shall, according to the actual situation of the project, specially formulate safety production and construction plans and special technical measures, and equip full-time (part-time) safety supervision and inspection personnel.
Article 7 Party B shall, from the date of commencement, set up safety protection facilities in line with national standards at the construction site, and equip operators with qualified personal protective equipment.
Eighth special types of workers, must participate in the construction administrative department or the relevant administrative departments of production safety education and training, after passing the examination, can work at their posts.
Article 9 In case of casualty accidents on the construction site, the construction enterprise shall report to the relevant administrative departments and Party A in accordance with the provisions of laws and regulations, and also report to the local construction administrative departments in a timely manner. Casualty accidents shall not be concealed, deliberately delayed or lied about.
Article 10 The construction site shall meet the following requirements:
(a) safe, clean and beautiful, and protect the communication facilities and equipment of the construction unit and Party A;
(2) The materials shall be stacked in an orderly manner, which will not affect the normal production order and smooth communication between the construction unit and Party A;
(three) timely disposal of garbage, shall not be dumped nearby;
(4) When outdoor construction is really necessary at night or in rainy days due to special circumstances, Party B must have safety construction measures (schemes) and report them to the project manager for approval before construction. If it is really necessary to construct on the expressway at night, night warning lights and safety fences shall be set up;
(5) meeting the hygiene standards;
(six) the building of temporary dormitory for workers should be firm and ventilated, and the lighting wires must be safe;
(seven) to prevent irrelevant personnel from entering the construction site.
Article 11 Party B shall abide by the following provisions:
(1) It is forbidden to melt asphalt or burn linoleum, paint and other substances that are easy to produce toxic and harmful smoke and gas at the construction site;
(two) shall not throw construction waste down from a height;
(three) toxic and hazardous waste shall not be backfilled;
(4) It is strictly forbidden to smoke or use naked flame in the construction site. If it is really necessary to work with naked fire due to construction, it must be approved by the security department to apply for a hot certificate;
(5) If it is necessary to enter the production machine room for construction, Party B shall go to the construction unit or the relevant department of Party A to handle the letter of introduction for entering the key communication parts before entering the construction.
(6) The engineering transport vehicles required for construction are owned or leased by the contractor. The contractor shall ensure that drivers can carry out regular maintenance on vehicles, and vehicles transporting equipment and materials should consider the transportation route, so as to observe traffic rules and pay attention to construction safety during transportation without any mistakes. The vehicles rented by the contractor for the project construction must be legal, complete in procedures and used in strict accordance with safety regulations.
Article 12 In case of violation of Article 6, Article 12 and Article 13 of this Agreement, Party A shall require Party B to make corrections, and Party B shall pay Party A a penalty of 1 1,000 yuan but not more than 5,000 yuan. Where laws and regulations provide otherwise, such provisions shall prevail.
Article 13 If Party B repeatedly violates the relevant provisions of this agreement, Party A has the right to cancel Party B's qualification to participate in communication engineering construction. If the circumstances are serious, it shall be reported to judicial organs for criminal responsibility.
Article 14 Any dispute arising from the execution of this Agreement shall be settled by both parties through consultation. If negotiation fails, it shall be settled by the people's court where Party A is located.
Article 15 This agreement, as an annex to the framework agreement on construction cooperation between the two parties, shall come into force as of the date of signing.

Article 1 Party A and Party B must conscientiously implement national and local laws, regulations, rules, norms, standards and other requirements.
Article 2 This Agreement refers to, but is not limited to, "all production safety problems that occur when Party B provides services for Party A, undertakes Party A's projects and engages in business related to Party A".
Article 2 Rights and obligations of Party A
(1) Party A shall strictly review the qualification certificate, safety management and other information provided by Party B before signing the construction contract with Party B;
(2) Party A requires that Party B's personnel must be equipped with personal protective equipment that meets the requirements of relevant standards according to Party A's requirements, and inspect and test the personal protective equipment provided by Party B.. Personnel who do not wear and use personal protective equipment are not allowed to enter the construction site; Party B shall equip and use equipment, facilities and tools that meet HSE requirements;
(3) Have the right to conduct safety supervision and inspection on the whole construction process of Party B, stop illegal operations, punish acts violating safety regulations or order the construction team to stop work for rectification;
(4) Party A has the right to order Party B's personnel with poor safety awareness to leave; If the circumstances are serious, Party A has the right to terminate the contract unilaterally, and does not bear the liability for breach of contract. If losses are caused to Party A, all responsibilities shall be borne by Party B;
(5) At the beginning of the year, Party A received the deposit from Party B in advance according to 5% of the total amount of 50% of the subject matter of the construction contract signed with Party B in the previous year, and collected the deposit in the second half of the year after half a year. Within three days after the signing of this agreement, Party B shall pay the security deposit to Party A's financial department. In case of being punished for production safety accidents, "three violations" or potential safety hazards, the losses and fines incurred shall be deducted from the security deposit. When the deposit amount is insufficient, Party A shall notify Party B in writing to pay it in time.
(VI) Before the construction of key equipment and key parts, Party A shall check Party B's construction plan and emergency plan, and give safety education and admission tips.
Article 3: Rights and obligations of Party B
(1) Party B must have the level qualification corresponding to the projects undertaken and the services provided, have the conditions for safe production that meet the requirements of laws, regulations and standards, have a sound safety management system and safety management system, have complete safety management personnel, complete safety management data and have good safety management performance for more than two years. The safety management data shall include the original records of safety accidents, accident incidence and "three violations" accident incidence for more than two years, as well as the archives of accident hidden danger management;
(2) Party B must pay the deposit in full according to the amount specified by Party A;
(3) Party B must strictly abide by the national laws, regulations, standards and specifications related to safety and environmental protection, as well as the relevant safety and environmental protection rules and regulations of the regions, departments, units and Cinda Group where the project belongs, so as to ensure safe production during the construction period;
(4) Party B shall carry out the construction in strict accordance with the construction contents of the project contract, and define the person in charge of construction (project manager) and safety supervision and their responsibilities;
(5) Party B's construction team must carry out the construction work according to the requirements of Xinda Group HSE management system;
(VI) Party B is responsible for handling medical and industrial injury social insurance for all its employees, and purchasing personal accident insurance for employees engaged in highly dangerous work according to regulations.
During the construction, all safety problems and accidents caused by its own reasons shall be borne by Party B;
(VII) Party B's on-site operators and operators of special types of work must go through the safety education and training organized by the construction administrative department or relevant administrative departments stipulated by laws and regulations and Party B, and can only take up their posts after passing the examination. If it is necessary to change jobs, increase or transfer personnel, safety education and skill assessment must be carried out before taking up their posts and reported to Party A for the record;
(VIII) Party B's employees shall not have symptoms that hinder their work, otherwise they shall not take part in the work. All registered construction personnel shall not be replaced at will, and shall not be an impostor;
(9) Before the project starts, the safety technical disclosure must be made to the construction personnel, so that all the construction personnel can master the engineering characteristics and construction safety measures;
(X) Before Party B's construction, the construction personnel shall correctly wear labor protection articles and protective articles that meet the standards; When entering key areas such as oil depot pumping station, construction personnel should consciously register at the guard's office, the personnel entering the station must wear passes, and the vehicles entering the station must wear fire-proof caps as required;
(eleven) before the start of construction machinery, instruments and safety protection facilities to conduct a comprehensive inspection, to ensure compliance with safety regulations does not exceed the inspection cycle. Party B's construction personnel shall carefully inspect the construction area, working environment, operating facilities, equipment and tools. Stop the construction immediately after finding hidden dangers, and continue the construction only after the rectification is implemented. All kinds of equipment and tools used during construction shall meet the construction requirements. Scaffolds on the construction site shall be inspected by special personnel every day before the start of construction, and the hidden dangers shall be rectified in time;
(12) obvious safety warning signs should be set up in the construction area, long-term concentrated construction projects should be closed, and construction personnel should move in the construction area, and they are not allowed to enter the non-construction area at will;
(13) The construction process involves direct operation links such as industrial fire, entering confined space and temporary electricity consumption, and Party B must handle relevant work permits in accordance with relevant regulations and procedures of the unit to which the project belongs.
(14) Party B shall consciously accept and unconditionally cooperate with the supervision and inspection of Party A's management personnel at all levels, and timely rectify the found nonconformities and hidden dangers; Party B has the right to refuse to carry out Party A's illegal command and force risks;
(15) In case of an emergency that seriously endangers the life safety of Party B's personnel, Party B has the right to take necessary measures to avoid risks;
(16) Party B shall not subcontract Party A's project again. In case of violation, accident and all losses and disputes caused by it, Party B shall bear all responsibilities;
(XVII) Party B shall employ workers in accordance with the Labor Law of People's Republic of China (PRC) and other laws, regulations and provisions, and it is strictly forbidden to use underage workers and personnel with occupational taboos for construction operations;
(18) Party B shall be responsible for the safety technical measures taken in the work area, the status of the working class personnel and the safety responsibilities during the construction period; If any accident or loss is caused to a third party due to improper safety measures taken by Party B or violation of relevant safety rules and regulations and safety matters listed in this agreement, or Party B is punished by the unit where the project is located, Party B shall bear the economic losses and legal responsibilities caused thereby;
(19) Before entering the construction of key equipment and key parts, Party B shall formulate the construction scheme and safety emergency plan for inspection by Party A and the construction unit, and require Party A to carry out safety education and prompt for admission.
Article 4 Responsibility
(1) Party B shall bear all economic losses and criminal responsibilities for all safety accidents within the period specified in this agreement, and shall be responsible for handling all disputes arising therefrom;
(II) If losses are caused to Party A or the construction party due to Party B's fault during the agreement period, Party B shall be responsible for compensating Party A and the construction party;
(3) In case of a safety accident due to Party B, Party A has the right to cancel the construction contract signed by both parties and cancel Party B's qualification to participate in other projects of Party A, and all consequences and compensation liabilities arising therefrom shall be borne by Party B;
(4) If Party B fails to perform the liability for compensation, Party A has the right to directly deduct the relevant losses and compensation from Party B's project payment. If it is not enough to pay compensation, Party A has the right to recover from Party B. ..
Article 5 Time limit
This agreement is valid for a long time. It is valid during the period when Party B provides services for Party A, undertakes projects of Party A and engages in business related to Party A. ..
Article 6 Settlement of disputes
Matters not covered in this agreement shall be settled by both parties through consultation. If negotiation fails, a lawsuit shall be brought to the people's court with jurisdiction in Dongying City, Shandong Province according to law.
Article 7 Others
This Framework Agreement and its annexes (Annex I: Construction Contract; Appendix 2: Site Safety Agreement) is an integral part of this Agreement. When Party B undertakes the specific project construction, it shall separately sign the project construction contract and safety production agreement at the construction site.
Article 8 Supplementary Provisions
This agreement is made in quadruplicate, with each party holding two copies, and shall come into effect as of the date when the legal representatives or authorized representatives of both parties sign and affix their official seals. The supplementary agreement confirmed by both parties has the same legal effect.
