Employment is the foundation of people's livelihood and an important part of building a harmonious socialist society. The CPC Central Committee and the State Council attached great importance to employment and reemployment. In 2002, they issued the Notice on Further Improving the Re-employment of Laid-off Workers (Zhong Fa [2002] 12) to solve this national problem.

The reemployment of laid-off workers in some enterprises has made positive efforts.

Employment policy, holding a national conference for three consecutive years to deploy employment and re-employment work. All localities and departments concerned have conscientiously implemented the policy, and social organizations have played an active role, so that various employment and reemployment support policies have been well implemented, the market-oriented employment mechanism has been further improved, the total employment has increased substantially, and a large number of laid-off and unemployed people have achieved reemployment, which has had a positive impact on promoting economic development, deepening the reform of state-owned enterprises and maintaining social stability. However, it must be noted that the basic pattern of oversupply of labor force in China will not change for a long time. In the next few years, the focus of employment and re-employment work will still be to solve the re-employment problem of laid-off and unemployed people left over from the system transition and the resettlement of employees of bankrupt enterprises after the restructuring and closure. At the same time, we should continue to do a good job in the employment and reemployment of college graduates, migrant workers and landless peasants. In order to further improve employment and reemployment, relevant issues are hereby notified as follows:

First, further clarify the objectives and tasks and develop jobs through multiple channels.

(1) The guiding ideology of employment and re-employment is: according to the requirements of Scientific Outlook on Development and building a harmonious socialist society, implement the national economic and social development plan during the Eleventh Five-Year Plan period, put the expansion of employment in a more prominent position in economic and social development, further implement the policy of "workers choose their own jobs, the market regulates employment, and the government promotes employment", while focusing on solving the re-employment problem left over from the system transition, strive to do a good job in the employment of new urban labor force and the transfer of rural surplus labor force, and gradually coordinate urban and rural employment.

(2) The main tasks of employment and re-employment are: basically solving the laid-off unemployment problems left over from the system transition, focusing on the re-employment of laid-off workers from state-owned enterprises, laid-off workers from collective enterprises and those who need to be resettled after the closure and bankruptcy of state-owned enterprises, consolidating the results of re-employment and enhancing employment stability; Strive to do a good job in the employment of new labor force in cities and towns, actively promote the employment of college graduates, and vigorously improve the vocational skills and entrepreneurial ability of workers while developing jobs; Improve the employment environment of migrant workers in cities and actively promote urban and rural overall employment; Strengthen unemployment control, control the number of registered unemployed in cities and towns within a reasonable range, and reduce the number of long-term unemployed; Accelerate the construction of employment legal system, and gradually establish a linkage mechanism between employment and social security.

(3) Develop jobs through multiple channels around economic development and do everything possible to expand employment.

1. Insist on solving the employment problem in development, and strive to achieve a benign interaction between promoting economic growth and expanding employment. We should organically combine deepening reform, promoting development, restructuring and expanding employment. When formulating economic and social policies involving the overall situation and determining major construction projects, we should consider expanding employment as an important factor. While paying attention to improving competitiveness, we should establish an economic structure and growth model conducive to expanding employment, timely analyze the impact of changes in the domestic and international economic situation on employment, and actively take corresponding countermeasures.

3. Fully implement the principles and policies of encouraging, supporting and guiding the development of individual, private and other non-public sectors of the economy, conscientiously implement the national policies and measures for developing the tertiary industry and service industry, and expand employment in promoting the development of the tertiary industry and diversified ownership economies.

3. Pay attention to the development of labor-intensive industries and small and medium-sized enterprises with comparative advantages and increase employment capacity. For industries with large employment capacity and large market demand, corresponding support policies should be formulated to encourage more employment.

4. Promote cross-regional labor cooperation and foreign labor export. Encourage resource-based cities and independent industrial and mining areas to develop continuous industries according to market demand, and guide the labor force to transfer employment.

5. Encourage workers to achieve employment through various forms, accelerate the improvement and implementation of policies such as labor relations, wage payment and social insurance that are compatible with flexible employment, and provide help and services for flexible employees.

6. Adhere to the coordinated development of urban and rural economy, adjust the rural economic structure, speed up the construction of small towns, guide and organize the transfer of rural labor force to non-agricultural industries and orderly flow to cities.

Second, further improve and implement the re-employment policy to promote the re-employment of laid-off workers.

(4) issue re-employment concession cards to laid-off workers of state-owned enterprises who have the ability to work and desire to find employment, those who need to be resettled after the closure and bankruptcy of state-owned enterprises, laid-off workers of collective enterprises run by state-owned enterprises (hereinafter referred to as large-scale collective enterprises run by factories), and other registered unemployed people in cities and towns who enjoy the minimum living guarantee for urban residents and have been unemployed for more than 1 year, and give corresponding policy support:

1. Encourage self-employment and self-employment.

Business tax, urban maintenance and construction tax, education surcharge and personal income tax shall be reduced or exempted in turn within the prescribed limits for those who hold re-employment concession cards and engage in self-employed businesses (except industries restricted by the state); And all kinds of administrative fees belonging to management, registration and licensing shall be exempted for a period of no more than 3 years. For those who have approved tax reduction or exemption before the end of 2005 but have not expired, the policy will be implemented within the remaining period.

Local people's governments at all levels and relevant departments should further co-ordinate and solve the business site problem of self-employed and individual workers.

Small secured loans can be provided to those who hold the Re-employment Concession Card and urban demobilized veterans who are engaged in self-employment and lack of self-financing The loan amount is generally controlled at around 20,000 yuan, and the longest loan period is no more than 2 years. If an extension is really necessary due, it can be extended 1 time. For partnership and organized employment, the loan scale can be expanded according to the number of people and business projects. Those who use the above two types of loans to engage in low-profit projects will be fully subsidized by the central government (no discount will be given during the extension period). The specific projects will be determined by the people's governments of provinces, autonomous regions and municipalities directly under the Central Government in light of the actual situation and reported to the Ministry of Finance, the Ministry of Labor and Social Security and the People's Bank of China for the record. For other registered unemployed people in cities and towns who apply for small secured loans and engage in low-profit projects, 50% discount will be given by the finance (the central finance and local finance will each bear 25%).

2. Encourage enterprises to absorb employment.

For commercial enterprises, service enterprises (except industries restricted by the state), processing enterprises in labor employment service enterprises and small business entities with processing nature in street communities, if employees with re-employment concession cards are newly recruited in the new posts that year, and they have signed labor contracts with them for more than 1 year and paid social insurance premium, business tax, urban maintenance and construction tax, education surcharge and enterprise income tax, they will be reduced or exempted in turn according to the actual number of employees within the corresponding period. For enterprises that have approved tax reduction or exemption before the end of 2005 but have not expired, they will continue to enjoy the tax reduction or exemption policy in the original way during the remaining period.

At the same time, the commercial enterprises and service-oriented enterprises in the above-mentioned enterprises shall be given social insurance subsidies for a corresponding period of time, with a maximum of three years. The social insurance subsidy standard is calculated according to the pension, medical care and unemployment insurance premiums that enterprises should pay for hiring personnel, and the pension, medical care and unemployment insurance premiums that individuals should pay are still borne by themselves. For enterprises that have approved social insurance subsidies before the end of 2005 but have not expired, this policy will be implemented within the remaining period.

For small labor-intensive enterprises that meet the loan conditions, if the number of newly recruited employees with re-employment concessions reaches more than 30% of the total number of existing employees in the newly added posts, and a labor contract is signed with them for more than 1 year, the loan amount shall be reasonably determined according to the actual number of employees, with the maximum not exceeding 654,380+00,000 yuan. Financial discount, handling bank fee subsidy, bad debt loss subsidy, etc. If it has been clearly stipulated, it shall be implemented in accordance with the relevant provisions.

3. Improve the stability of flexible employees.

For the "4050" personnel who hold the "Re-employment Concession Card" (that is, women are over 40 years old and men are over 50 years old. The deadline for calculating the age is determined by all localities. After flexible employment, those who apply for employment and participate in social insurance will be given a certain amount of social insurance subsidies for a period of not more than 3 years.

(5) For those with employment difficulties who hold the Re-employment Concession Card (including: laid-off workers from state-owned enterprises, laid-off workers from large collective enterprises run by factories, and "4050" personnel who need to be resettled due to the closure and bankruptcy of state-owned enterprises; Long-term unemployed people who enjoy the minimum living guarantee for urban residents and have difficulties in employment can be regarded as the focus of employment assistance and given corresponding policy support:

Government investment in the development of public welfare posts should give priority to people with employment difficulties. If people with employment difficulties are arranged in public welfare posts and labor contracts are signed with them for more than 1 year, social insurance subsidies for the corresponding period shall be given according to the actual number of people recruited. The social insurance subsidy standard is calculated according to the pension, medical care and unemployment insurance premiums that the unit should pay for the recruited personnel. If the above-mentioned "4050" personnel have worked in public welfare posts for more than 3 years, the period of social insurance subsidies may be extended accordingly (the funds required for social insurance subsidies for more than 3 years shall be solved by local finance). Social insurance subsidies that have been approved before the end of 2005 but have not yet expired shall be implemented according to this policy.

3. All localities may, according to the actual situation, give appropriate post subsidies to people with employment difficulties who work in public welfare posts. The subsidy standard is determined by the local government, and the required funds are solved by the local finance.

(six) all localities should follow the principle of territorial management and further improve the re-employment of laid-off workers from centrally managed enterprises within their respective jurisdictions. Incorporate the laid-off workers of these enterprises into the local re-employment work plan and make overall arrangements for implementation. For laid-off and unemployed workers in centrally managed enterprises, the "Re-employment Concession Card" should be issued in a timely manner, and the re-employment policy should be implemented. The required funds should be solved by local finance as a whole.

(seven) to strengthen the "re employment concession card" issuance and management. Strict "Re-employment Concession Card" review and issuance procedures to prevent fraud, deception and other acts. Those who rent, transfer or forge the "Re-employment Concession Card" shall be dealt with severely according to law. All relevant departments should strengthen communication and coordination, establish a system of information exchange and investigation on reemployment of laid-off and unemployed workers, identify the re-employment concession card in time after providing policy support, and recover the re-employment concession card in time for those who have gone through retirement procedures. "Re-employment Concession Card" is applicable in the provinces (autonomous regions and municipalities) that issue the card, and the specific measures shall be formulated by the provincial people's government.

(8) All localities may, according to local conditions, extend the application scope of the above policies (excluding tax revenue policy) to laid-off workers of other collective enterprises in cities and towns, and the required funds shall be solved by local finance.

Third, promote urban and rural employment, improve employment services and strengthen vocational training.

(nine) the establishment of employment management service organization system covering urban and rural areas, and the overall management of urban and rural labor resources and employment. Improve farmers' employment environment in cities, remove restrictions on rural laborers' employment in cities and across regions, and improve policies and measures to protect the legitimate rights and interests of rural laborers in cities and across regions. Carry out the pilot work of urban-rural integration labor market in conditional areas.

(10) Improve the public employment service system. In accordance with the requirements of institutionalization, specialization and socialization, we will comprehensively promote "people-oriented" employment services and improve the quality and efficiency of public employment services. Public employment service agencies shall provide free job introduction services to those who hold re-employment concession cards, other registered unemployed people in cities and towns, and rural workers who register to apply for jobs in cities. Develop and standardize all kinds of employment agencies and social service agencies such as labor dispatch, career counseling and guidance, and employment information services, and encourage all kinds of social employment agencies to provide honest and effective employment services for urban and rural workers. It is necessary to improve the subsidy policy for job introduction, establish a mechanism linked to service effectiveness, and subsidize all kinds of job intermediary agencies that provide free job introduction services.

(eleven) to strengthen the construction of labor market information system. In accordance with the overall requirements of the construction of the "Golden Insurance Project", the construction of the labor market information system is planned in a unified way and promoted as a whole. Focusing on the main tasks of employment work and the needs of clients, we will optimize business processes and gradually realize the comprehensive informationization of employment services and unemployment insurance business. Realize the information networking of public employment service agencies at all levels, regularly analyze and publish information on job supply and demand and wage level, improve the online job introduction function, provide convenient and fast information services for job seekers and employers, and improve the matching efficiency of supply and demand in the labor market.

(twelve) to strengthen the construction of street (township) community labor security platform, and give full play to its basic role in promoting employment and re employment and socialized management services for retirees. Relying on the street (township) community labor and social security work platform, establish a reemployment assistance system, focus on helping people with employment difficulties, and provide targeted employment services and public welfare post assistance. Township labor and social security institutions should further improve their service functions, improve their working methods and strengthen basic management. Continue to strengthen the construction of community labor and social security work team, strengthen business training, improve the quality of work, and implement work funds.

Summarize the experience of establishing credit cooperatives in some areas, explore the linkage mechanism of establishing credit cooperatives, entrepreneurship training and small secured loans in combination with the construction of personal credit system, and create conditions for laid-off workers to find jobs and start businesses.

(thirteen) widely mobilize the education and training resources of the whole society, carry out multi-level and multi-form vocational training for urban and rural workers, actively promote entrepreneurship training, and improve the employability and entrepreneurial ability of workers. Provide one-time vocational training subsidies to those who hold the "Re-employment Concession Card", other registered unemployed people in cities and towns and rural workers who work in cities. It is necessary to identify a number of education and training institutions with high training quality and good employment effect as designated institutions through qualification identification. Improve the mechanism of linking training subsidies with training quality and promoting employment, and guide all kinds of education and training institutions to actively carry out targeted training according to market demand. Mobilize all social forces to speed up the cultivation of highly skilled talents to meet the needs of enterprises.

Give full play to the multiplier effect of entrepreneurship driving employment. Carry out entrepreneurship training for urban and rural workers with entrepreneurial aspirations and conditions, provide "one-stop" services such as entrepreneurship guidance, project development, small secured loans, and follow-up support, provide small secured loan financial support to entrepreneurship training graduates, and strive to provide follow-up services.

Vigorously carry out vocational training to improve the employability of migrant farmers. According to their characteristics and employment needs, carry out targeted and practical training and provide vocational skills appraisal services. Make full use of TV remote training and other means to send skills knowledge and employment information to farmers. Organize and implement the national training plan in key industries that absorb more rural labor force and poor areas that organize labor export.

The training and employment services for landless farmers shall be considered by all localities as a whole, and the required funds and land acquisition expenses shall be arranged as a whole.

(fourteen) to strengthen vocational skills training and skill appraisal services. Fourth, implement unemployment control and strengthen employment management.

For industries and enterprises that directly affect employment due to major changes in the domestic and international economic situation, as well as difficult areas and industries with prominent unemployment problems, special policies and measures should be taken in time to reduce the unemployment rate and maintain a stable employment situation.

(16) We will continue to encourage large and medium-sized state-owned enterprises to separate their main businesses and reorganize their auxiliary businesses, make full use of the non-main business assets, idle assets and effective assets of closed bankrupt enterprises, reorganize and set up market-oriented, independent accounting and self-financing legal person economic entities (except industries restricted by the state), and resettle the surplus staff of enterprises. If the property rights are clear and gradually diversified, and more than 30% of the surplus staff of the original enterprise are absorbed, and a new labor contract is changed or signed with them, the enterprise income tax will be exempted within 3 years after being identified by the relevant departments and audited by the tax authorities.

(seventeen) steadily promote the restructuring and bankruptcy of state-owned enterprises, strictly examine and supervise the implementation of the employee resettlement plan, standardize the business behavior of enterprises, and safeguard the legitimate rights and interests of employees. When a state-owned enterprise is reorganized, restructured, closed or bankrupt, the employee placement plan must be discussed and approved by the enterprise employee congress or the employee congress. An enterprise whose employee placement plan and social security measures are unclear and whose funds are not implemented shall not enter the reorganization, restructuring and bankruptcy procedures. It is necessary to guide enterprises to publicize policies in depth through various effective forms in the preparation stage of closure and bankruptcy, so that employees can understand the policy content and operation process. It is necessary to effectively strengthen the supervision and guidance on the placement of employees in the process of enterprise closure and bankruptcy. After bankruptcy, it is necessary to do a good job in employee placement and social security in time and properly handle the remaining problems.

Enterprises that have laid off more than a certain number and proportion at one time should report to the local government in advance. Those who fail to pay the economic compensation for the termination of the labor contract and properly solve the debts owed to employees according to law shall not lay off employees.

(nineteen) deepen the reform of the labor market system and break the urban-rural and regional division of the labor market. Standardize the labor market order and earnestly safeguard the legitimate rights and interests of urban and rural workers. Regularly carry out activities to clean up and rectify the labor market, strengthen supervision over all kinds of professional intermediary behaviors, severely crack down on violations of laws and regulations in the labor market, and standardize the behavior of workers in job hunting, employers and professional intermediaries. Establish an administrative licensing system for labor dispatch and standardize labor dispatch behavior. Enrich the labor security law enforcement and supervision team, strengthen law enforcement and supervision, and strictly prohibit and resolutely correct overtime work, failure to sign labor contracts, deliberate depression and arrears of wages, failure to pay social insurance premiums as required, and arbitrary layoffs.

Seriously sum up the experience of employment and re-employment, study and formulate laws and regulations to promote employment, clarify and strengthen effective policies and measures, and lay the foundation for forming a long-term mechanism to solve employment problems under the conditions of market economy.

Five, to further improve the social security system, establish and promote the employment linkage mechanism.

Since 2006, newly laid-off employees of enterprises have been re-employed through the labor market, and those who have not been re-employed are entitled to unemployment insurance and minimum living security for urban residents according to regulations. All localities should continue to take effective measures to properly solve the remaining problems of the merged personnel in re-employment, social insurance relations and labor relations.

(twenty-five) to further play the role of the unemployment insurance system to promote re employment. Under the premise of carefully analyzing the income and expenditure and balance of the unemployment insurance fund and making overall consideration of the arrangement of local financial employment and re-employment funds, the eastern region can conduct a pilot project to appropriately expand the expenditure scope of the unemployment insurance fund in light of local conditions, and the specific measures shall be formulated by the Ministry of Labor and Social Security and the Ministry of Finance.

(26) Further improve the social insurance system. We will continue to strengthen the collection and payment of social insurance, do a good job in continuing the social insurance relationship of laid-off and unemployed people after re-employment, and bring more workers into the coverage of the social insurance system. It is necessary to gradually unify the policy of urban individual industrial and commercial households and flexible employees to participate in endowment insurance, improve the basic pension calculation and payment methods, strengthen the incentive and restraint mechanism linked to payment and treatment, and form a benign interaction between promoting employment and improving the social insurance system. Actively create conditions to provide necessary social security for migrant workers who work in cities.

Six, continue to strengthen organizational leadership, mobilize all social forces to participate in employment and re employment.

(twenty-seven) people's governments at all levels and relevant departments should continue to consolidate and strengthen the target responsibility system for employment and reemployment. We will continue to incorporate new employment and unemployment control into macro-control indicators for national economic and social development. To solve the problem of laid-off unemployment left over from the system transition, promote the employment of new labor force in cities and towns, promote the overall employment of urban and rural areas, strengthen unemployment control and realize the linkage mechanism between employment and social security system as the main objectives and tasks, decompose them layer by layer, incorporate them into the important content of performance appraisal, and conduct regular supervision and inspection.

(twenty-eight) people's governments at all levels and relevant departments should further strengthen the leadership and overall coordination of employment and re employment. In order to meet the requirements of the new situation and new tasks, the State Council decided to adjust the inter-ministerial joint meeting system for re-employment to the inter-ministerial joint meeting system for employment, and local people's governments at all levels should also make corresponding adjustments to the joint meeting system to form a working mechanism of unified leadership and division of labor and cooperation. Under the direct leadership of the people's governments at all levels, all members of the joint meeting should conscientiously perform their duties, strengthen coordination and cooperation, and do a good job in employment and reemployment.

(twenty-nine) people's governments at all levels should actively adjust the structure of fiscal expenditure and increase capital investment according to the changes in the employment situation and the needs of employment work, and incorporate the funds for promoting employment and re-employment into the fiscal budget. For the central and western regions and old industrial bases, the central government continues to give appropriate subsidies through special transfer payments, which are mainly used for job introduction subsidies, vocational training subsidies, social insurance subsidies, and interest subsidies for small secured loans. In addition, governments at all levels should also reasonably arrange funds for the labor market, street (township) community labor security platform construction and so on. It is necessary to strengthen the supervision and inspection of the distribution and use of funds for employment and re-employment, and use the funds for special purposes to improve the efficiency of the use of funds.

(30) Give full play to the positive role of democratic parties, federations of industry and commerce, trade unions, the Communist Youth League, women's federations and other people's organizations in assisting the government in formulating policies, uniting all parties to actively participate, publicizing and mobilizing, social supervision, and helping the masses to start businesses and obtain employment. Give support in organizing all kinds of training, providing all kinds of services, improving the service ability of entrepreneurship and employment, and form a situation in which the whole society participates and Qi Xin works together to do a good job in employment and re-employment.

(32) The above-mentioned relevant support policies have been implemented since 2006, and the deadline for policy approval is tentatively set at the end of 2008. In the process of policy implementation, if the country carries out tax reform, the relevant tax policies will be implemented according to the new tax policies.

All regions and relevant departments should study and formulate specific measures and detailed rules for the implementation of this notice in light of local conditions to ensure that the spirit of this notice is implemented. On the premise of not involving tax policy, not affecting the central non-tax revenue, and not increasing the central financial subsidies, other policies that are conducive to expanding urban and rural employment can be formulated.
