Measures of Tianjin Municipality on the Administration of Collecting and Using Enterprise Credit Information by Administrative Organs

Article 1 These Measures are formulated in accordance with relevant laws and regulations in order to promote the construction of credit system in this Municipality, standardize the market economic order, enhance the credit awareness of enterprises, promote the information disclosure and sharing of administrative organs in this Municipality, and provide information services to the society. Article 2 These Measures shall apply to the collection, storage, statistics, management, analysis, generation and use of enterprise credit information by administrative organs of this Municipality.

The term "administrative organs" as mentioned in these Measures includes administrative organs at all levels in this Municipality and organizations authorized or entrusted by law to undertake administrative functions. Article 3 The term "enterprise credit information" as mentioned in these Measures refers to the credit-related behavior records of various enterprises and their business activities generated in the process of administrative organs performing their duties according to law.

All kinds of enterprises mentioned in the preceding paragraph include enterprise legal persons, other economic organizations and individual industrial and commercial households engaged in business activities within the administrative area of this Municipality, hereinafter referred to as enterprises. Article 4 The Municipal People's Government shall establish the Tianjin Enterprise Credit Information System (hereinafter referred to as the Enterprise Credit Information System), with the organization code as the only legal code of the enterprise, collect and use the enterprise credit information through the computer network, realize the information interconnection and sharing of administrative organs, provide basic information services for administrative management, and finally provide information inquiry services for the society. Article 5 The Municipal People's Government shall strengthen the leadership over the construction of enterprise credit information system to ensure the smooth progress of the system construction. The municipal information department is responsible for the specific organization and implementation of these measures. Municipal development and reform, finance, industry and commerce and other relevant departments shall do relevant work within the scope of their duties. Article 6 Enterprise credit information consists of basic information, prompt information, warning information and good information.

Enterprise credit information includes: enterprise registration, annual inspection information provided by industrial and commercial departments, investigation and punishment of fines and confiscations, tax payment credit information provided by tax departments, illegal smuggling information provided by customs, quality supervision organization code and commodity bar code information provided by quality supervision departments, information on various funds paid by employees provided by labor and social security departments, and safety production information provided by comprehensive safety production management departments. Other relevant administrative organs should actively create conditions to incorporate them into the enterprise credit information system in a planned and step-by-step manner, and constantly enrich the enterprise credit information. Article 7 The basic information system shall record the following information:

(a) the basic situation of enterprise registration;

(2) The special administrative license obtained by the enterprise;

(3) the qualification grade of the enterprise;

(four) the results of special or regular inspections of enterprises by administrative organs according to law;

(5) Other information about enterprise identity registered by the administrative organ according to law.

The information specified in the preceding paragraph includes the contents of registration, alteration, cancellation or revocation. Article 8 The prompt information system shall record the following information:

(a) the enterprise was fined or confiscated for illegal acts;

(2) The enterprise fails to pass various special or regular inspections;

(three) other illegal acts of the enterprise that the administrative organ thinks should be notified. Article 9 An early warning information system shall record the following information:

(a) the enterprise was ordered to stop production and business due to illegal acts, and its license or business license was revoked or revoked by the administrative organ;

(two) the enterprise failed to pass the special or regular inspection due to serious illegal acts, and was rated as unqualified after inspection;

(three) the enterprise was fined or confiscated administrative punishment for the same illegal act for more than two times;

(four) other serious illegal acts of enterprises that disrupt the order of market economy and endanger the safety of transactions;

(five) the enterprise is investigated for criminal responsibility for illegal crimes. Article 10 The following information of the legal representative and principal responsible person of an enterprise shall be recorded in the early warning information system:

(1) Being directly responsible for the serious illegal acts of this enterprise;

(2) The penalty is being executed;

(3) Being sentenced for committing the crime of corruption and bribery, property infringement or disrupting the order of the socialist market economy, being sentenced for committing other crimes within five years, and being deprived of political rights for committing crimes within five years;

(4) Being the legal representative, director or manager of an enterprise that went bankrupt and liquidated due to poor management, and being personally responsible for the bankruptcy of the enterprise, and less than 3 years have passed since the end of the bankruptcy liquidation of the enterprise;

(five) the amount of personal debt is large, and it has not been paid off at maturity;

(6) Other circumstances in which he cannot be the legal representative or principal responsible person of the enterprise as stipulated by laws, regulations and rules. Eleventh the following information is recorded in a good information system:

(a) the enterprise and its legal representative and principal responsible person are commended by the administrative organ at or above the municipal level;

(two) was named "Tianjin contract, trustworthy enterprise";

(3) Being recognized as a "well-known trademark in China";

(4) Being rated as "AAA" credit rating by financial institutions;

(five) through the international quality standard certification, the product is included in the national inspection-free scope;

(six) other enterprise credit information that can be recorded by the municipal administrative organ. Twelfth administrative organs through the government private network, in accordance with the unified standards and requirements stipulated by the municipal government, timely and accurately provide true, legal and complete enterprise credit information to the enterprise credit information system, and bear the corresponding legal responsibilities.

According to the provisions of the preceding paragraph, the municipal administrative organ is responsible for determining and publishing the specific items and scope of the enterprise credit information of this system, collecting and sorting out the information of this system, and being responsible for uniformly submitting, maintaining, updating and managing the information.
