Article 4 Construction project cost activities shall follow the principles of legality, objectivity, impartiality, independence and good faith, and shall not harm national interests, social interests and the legitimate rights and interests of others. Article 10 The municipal construction administrative department shall establish a construction project cost information platform, a basic database and a market price monitoring and early warning mechanism, regularly collect, calculate and publish relevant information such as market prices, indexes and indicators of construction project cost elements, and use big data and other means to carry out construction project cost information monitoring. Article 15 When determining the contract price, the employer and the contractor shall consider the influence of market environment and price changes of production factors on the contract price. For construction projects priced by bill of quantities, the employer and the contractor may determine the contract price by using the unit price. For construction projects with small scale, low technical difficulty and short construction period, the employer and the contractor may determine the contract price in the form of total price. For construction projects with particularly complicated emergency rescue, disaster relief and construction technology, the employer and the contractor may determine the contract price by means of cost plus remuneration. Article 16 A construction project whose construction period exceeds 1 year as stipulated in the construction contract shall be settled during the construction.
The tender documents and the construction contract shall stipulate the settlement period or node, measurement and pricing methods, risk scope, acceptance requirements, and the payment time, procedures, methods and proportion of the price.
