Excellent historical buildings belong to cultural relics, and their protection and utilization should also comply with the Law of People's Republic of China (PRC) on the Protection of Cultural Relics and relevant laws and regulations. Article 4 The protection of outstanding historical buildings shall follow the principles of giving priority to protection, giving priority to rescue and rational utilization, maintain and continue the traditional pattern and historical features, and safeguard the authenticity and integrity of outstanding historical buildings. Article 5 The people's governments of cities and counties (cities, districts) shall be responsible for the protection and utilization of outstanding historical buildings within their respective administrative areas, establish a coordination mechanism, strengthen leadership over the protection of outstanding historical buildings, and set up special funds for the protection of outstanding historical buildings, which shall be used for subsidies for the protection of outstanding historical buildings, repair subsidies, loan interest subsidies for the utilization of outstanding historical buildings, government incentives, etc. Sixth city and county (city, district) cultural and tourism administrative departments in conjunction with the administrative departments of natural resources and planning to carry out the investigation and identification, protection guidance, supervision and management of outstanding historical buildings.
Development and reform, housing and urban and rural construction, urban management, public security, emergency management, ecological environment, ethnic and religious, finance and other relevant departments shall, in accordance with their respective responsibilities, do a good job in the protection of outstanding historical buildings. Seventh Township People's governments and sub-district offices shall undertake the following functions in the protection of outstanding historical buildings:
(a) to organize the protection and repair of outstanding historical buildings within their respective administrative areas;
(2) Improve the supporting infrastructure of excellent historical buildings;
(three) to coordinate the rational development and utilization of excellent historical building resources;
(four) the implementation of fire safety responsibilities and measures;
(five) to stop acts in violation of the provisions on the protection of outstanding historical buildings according to law;
(six) to organize the investigation and declaration of outstanding historical buildings within the jurisdiction;
(seven) to guide and urge the village (neighborhood) committees to do a good job in the protection of outstanding historical buildings. Eighth people's governments at all levels and their relevant departments should strengthen publicity and education on the protection of outstanding historical buildings, and enhance the awareness of protecting outstanding historical buildings. Units and individuals that have made outstanding contributions to the protection of outstanding historical buildings shall be commended or rewarded by the local people's government or relevant departments. Chapter II Determination of Protection List Article 9 This Municipality implements the system of protection list of outstanding historical buildings. Any unit or individual may put forward suggestions to the municipal administrative department of culture and tourism or the municipal administrative department of natural resources and planning to include cultural relics with protection value in the protection list.
Those that have been approved and announced as cultural relics protection units at or above the provincial level are directly listed in the list of outstanding historical buildings. Tenth buildings (structures) that meet one of the following conditions can be recognized as excellent historical buildings:
(a) highlight the local social production and life history in different historical periods;
(two) architectural style, structure, materials, construction technology and engineering technology have architectural artistic characteristics and scientific research value;
(three) highlight the historical and cultural characteristics of local buildings;
(4) representative works of local representative, landmark buildings or famous designers;
(five) the former residence of important local celebrities or memorial buildings (structures);
(six) other buildings (structures) with historical and cultural significance. Article 11 The municipal administrative department of culture and tourism shall, jointly with the municipal administrative department of natural resources and planning, regularly investigate buildings (structures) with protection value, put forward a list of suggestions for the protection of outstanding historical buildings according to the survey results, organize expert review and solicit the opinions of the township people's government, neighborhood offices and village (neighborhood) committees where historical buildings are located, and report them to the Municipal People's government for approval and promulgation. Twelfth list of outstanding historical buildings approved according to law shall not be changed without authorization. Due to special reasons such as natural disasters, outstanding historical buildings do not exist or are damaged beyond repair. After being approved and announced by the municipal administrative department of culture and tourism, they will be deleted from the list. Chapter III Protection and Utilization Article 13 The people's governments of cities and counties (cities, districts) shall set up unified protection signs for outstanding historical buildings, clearly list them, and establish archives of outstanding historical buildings.
Excellent historical building archives shall include the following contents:
(1) Architectural artistic features, historical features, construction date and rarity;
(two) the relevant technical information of the building;
(three) the use of the building and the change of ownership;
(four) the text, drawings, pictures, images and other materials formed in the process of building repair and decoration;
(5) Building surveying and mapping information records and related materials. Fourteenth city and county (city, district) administrative departments of culture and tourism shall, jointly with the administrative departments of natural resources and planning, prepare the protection plan for each outstanding historical building, and announce it to the public after being approved by the people's government at the same level. The protection map of outstanding historical buildings shall include the following contents:
(a) the name, address, number and other basic attributes of outstanding historical buildings;
(two) the style of outstanding historical buildings and their related environmental factors;
(three) the requirements for the protection and utilization of outstanding historical buildings, including the types of protection, functional purposes, key protection contents and internal and external facilities.
Excellent historical buildings belonging to cultural relics protection units should also specify the scope of protection and the necessary construction control zones. The protection scope and construction control zone delineated in the protection plan shall be listed as the contents of the overall planning and regulatory detailed planning of urban and rural construction in this administrative region. Township planning and village planning should make specific arrangements for the protection of outstanding historical buildings.
