Civil litigation must have a clear original defendant. Without the following information of the defendant, the court will not accept it: name, age, native place, permanent residence and contact information. Other personal data, such as ID number and copy, are not needed. Among them, the name and age are not required to be absolutely correct. For example, a word in the defendant's name is wrong, but it doesn't matter whether it is similar to the word in the defendant's real name in sound and shape, and so does age. Contact information and address are the main ways to inform the defendant, and at least one of them can contact the defendant. If the name or age of the plaintiff and the defendant in the indictment is too different from the actual name or age of the defendant, resulting in that the defendant provided by the plaintiff does not exist at all, or the contact information and address are wrong, resulting in the failure to deliver the notice of responding to the lawsuit, if there is no defendant responding to the lawsuit, it shall be deemed that the plaintiff has no clear defendant in the lawsuit and the lawsuit shall be dismissed. According to the law, when writing a complaint, the plaintiff must specify the defendant's name, gender, age, nationality, occupation, work unit, residence and contact information. For the defendant's ID number, you can leave it blank. When the plaintiff brings a civil lawsuit to the people's court, it is not necessary to explain the defendant's information in detail. As long as the information provided by the plaintiff can distinguish the defendant from others and the people's court can clearly know who the defendant is, the people's court will file a case to hear the civil lawsuit filed by the plaintiff. If the information provided by the plaintiff cannot distinguish the defendant from others and does not meet the statutory conditions for prosecution, the people's court shall not file a case and inform it of the reasons for not filing a case. If the plaintiff knows and can provide other information about the defendant, he may bring a civil lawsuit to the people's court again.
