Interim Measures of Xinjiang Uygur Autonomous Region for selecting project owners through public bidding for public resources development and construction projects such as thermal power, wind power and photovoltaic. Article 1 In order to promote the orderly development and construction of public resources such as thermal power, wind power and photovoltaics, standardize the investment behavior of enterprises, create an open, fair and just investment environment, and promote the sustained and healthy development of the power industry, these Interim Measures are formulated in accordance with the Bidding Law of People's Republic of China (PRC) and the Implementation Regulations of the Bidding Law of People's Republic of China (PRC), combined with the actual situation of the autonomous region. Article 2 For projects to be included in the annual thermal power construction plan and the annual wind power and photovoltaic development and construction plan of the National Energy Administration within the administrative region of the autonomous region, the project owners shall be selected through public bidding in accordance with these Interim Measures. Article 3 The development and reform department of the autonomous region or the people's government (administrative office) of the state or city where the project is located shall, according to the electric power development plan of the state and the autonomous region, entrust a qualified consulting and design institution to organize the preparation of the planning scheme for the construction of thermal power projects, wind power and photovoltaic bases, and after performing the examination and approval procedures, it shall serve as the basis for selecting the project owner through public bidding. Article 4 The development and reform department of the autonomous region or the people's government (administrative office) of the state or city where the project is located shall be the tenderee of the thermal power project. The people's government (administrative office) of the state or city where the project is located is the tenderer for wind power and photovoltaic power generation projects.

The tenderer shall entrust a qualified tendering agency to handle the bidding matters. Article 5 A tenderer shall prepare tender documents according to the characteristics and needs of thermal power, wind power and photovoltaic projects. The tender documents include all substantive requirements and conditions such as the technical requirements of the construction project, bidder qualification examination standards, bid quotation requirements and bid evaluation standards, and the main terms of the contract to be signed.

The tenderee shall publicly release the tender announcement to the public. Article 6 A bidder shall prepare the bidding documents in accordance with the requirements of the bidding documents. The bidding documents shall respond to the substantive requirements and conditions put forward in the project bidding documents. Article 7 The development and reform department of the autonomous region shall, in accordance with the provisions of relevant laws and regulations, establish an expert database for bid evaluation of power projects, including experts, scholars, engineering technology and management personnel with rich experience in power planning, engineering construction and operation and maintenance. Article 8 The bid evaluation committee established by the tenderer according to law shall be responsible for bid evaluation. The bid evaluation committee is composed of technical and economic experts and representatives of the tenderee, with an odd number of members of more than five, of which the technical and economic experts shall not be less than two thirds of the total number of members.

The bid evaluation experts are randomly selected from the power project bid evaluation expert database. Article 9 The bid evaluation committee shall evaluate and compare the bid documents according to the bid evaluation standards and methods determined in the bidding documents. After completing the bid evaluation, the bid evaluation committee shall submit a written bid evaluation report to the tenderer and recommend qualified candidates for winning the bid. The tenderer shall determine the winning bidder according to the written bid evaluation report put forward by the bid evaluation committee and the recommended candidate winning bidders. The project bidding related business stipulated in Article 10 of the Interim Measures shall be carried out on the public resource trading platform of the autonomous region. Eleventh in violation of the provisions of the Interim Measures, should bear legal responsibility, in accordance with the provisions of relevant laws and regulations. Twelfth autonomous region development and Reform Commission in accordance with the "People's Republic of China (PRC) Bidding Law", "People's Republic of China (PRC) Bidding Law Implementation Regulations", combined with the actual situation of thermal power, wind power, photovoltaic project construction, formulate specific implementation rules. Thirteenth the Interim Measures shall come into force as of September 30th, 20 16.
