What are the procedures for lawyers to inquire about personal information?

When inquiring about personal information, lawyers need to bring the original and photocopy of lawyer's practice certificate and letter of introduction from law firm. Ways for lawyers to inquire about personal information:

1. If a lawyer investigates and collects evidence by himself, he may, with the lawyer's practice certificate and the certificate of the law firm, investigate the situation related to undertaking legal affairs with the relevant units or individuals.

2. After accepting a case, a lawyer may also apply to the court or procuratorate for obtaining the personal information of the parties to the case with the lawyer's practice certificate and the certificate of the law firm.

Matters needing attention for lawyers to check the household registration certificate are as follows:

1. A practicing lawyer who has obtained a lawyer's practice certificate according to law can inquire about the citizen's household registration information because of the need to undertake legal affairs. Lawyers and paralegals who have not obtained a lawyer's practice certificate may not inquire about citizens' household registration information separately.

2. When inquiring about the citizen's household registration information, a practicing lawyer shall bring the original and photocopy of the lawyer's practice certificate and a letter of introduction from the law firm. The letter of introduction of a law firm shall specify the lawyer's name, legal affairs undertaken, the name of the inquired person or the citizen's identity number, etc. And the relevant materials after verification shall be kept by the public security organ.

3. When inquiring, the public security organ shall inform the inquirer of his responsibilities and obligations. The public security organ may provide the inquiry result to the inquiry applicant in writing. The contents provided include eight static household registration items such as name, gender, nationality, date of birth, address of permanent residence, citizenship number, photo and police station, and other information and electronic documents of the inquired person are not allowed.

4, practicing lawyers to inquire about citizens' household registration information, in principle, through the local police station where the inquired person's permanent residence is located. The Provincial Department of Justice and the Public Security Department will actively promote the construction of online inquiry mechanism and explore the establishment of convenient and fast inquiry methods.

5. Lawyers shall reasonably use the household registration information of the inquired citizens according to law, and shall not disclose the privacy of relevant personnel. Violation of relevant laws and regulations and practice discipline will be investigated and dealt with according to law.

6. Local public security organs' household registration, judicial administrative organs' legal institutions and lawyers' management institutions should strengthen cooperation, establish a joint meeting system, regularly report their work, study and solve problems encountered in their work, provide services for lawyers to inquire about citizens' household registration information according to law, and effectively protect lawyers' practice rights.
