Chapter II Real Estate Development Enterprises Article 7 Only enterprises established according to law and having obtained the qualification certificate of real estate development can engage in real estate development and business activities.
Real estate development enterprises (hereinafter referred to as development enterprises) shall undertake real estate development projects corresponding to their qualification levels in accordance with the relevant provisions of the state and the province. Eighth newly established development enterprises shall apply to the qualification examination and approval department for temporary qualification according to the regulations. The qualification examination and approval department shall issue temporary qualification certificates to qualified development enterprises.
The temporary qualification certificate is valid for one year. The development enterprise shall, thirty days before the expiration of the temporary qualification certificate, apply to the qualification examination and approval department for the extension or approval of the qualification grade.
Within one year from the date of receiving the temporary qualification certificate, if the development enterprise has not obtained the transfer contract or allocation decision of the right to use state-owned construction land, the validity period of the temporary qualification certificate shall not be extended. Article 9 If the name, domicile and legal representative of a development enterprise change, it shall go through the formalities for changing the qualification certificate within 30 days after the change registration of the market business entity. Article 10 Where a development enterprise is divided, merged or terminated, it shall, within 30 days after handling the registration of the corresponding market business entity, apply to the qualification examination and approval department for re-verification of the qualification grade or go through the formalities for cancellation of the qualification certificate. Eleventh development enterprises should establish and improve the after-sales service system, set up after-sales service institutions for commercial housing, handle consultation, complaints, coordination and other service matters, and establish after-sales service files. Twelfth development enterprises shall, in accordance with the relevant provisions, timely submit statistical data to the competent department of real estate development statistics, and be responsible for the authenticity of the submitted data. Article 13 The competent department of real estate development shall, in accordance with the relevant laws, regulations and rules, and in combination with the actual situation such as the manual of real estate development projects and the credit information of development enterprises, inspect the qualification licensing conditions and development and business activities of development enterprises within its jurisdiction, and the annual random sampling ratio shall not be less than 20%.
The competent department of real estate development shall promptly send a copy of the inspection results to the administrative examination and approval, comprehensive law enforcement and other departments, and at the same time incorporate the inspection results into the credit information files of development enterprises. Fourteenth city real estate development departments shall, jointly with relevant departments, establish and develop enterprise credit information files and incorporate them into the municipal public credit information platform.
The development of enterprise credit information files includes enterprise management, good faith performance, social supervision and evaluation, rewards and punishments and other information, and records the credit information of its main investors.
The credit information of development enterprises shall be collected by relevant departments and units, and the development enterprises shall declare and give public feedback. The competent department of real estate development shall verify the relevant information and make records. Fifteenth city real estate development departments in accordance with the comprehensive credit data formed by information collection, credit evaluation of enterprises and the implementation of dynamic management, evaluation results in a timely manner to the public.
