New regulations for housing verification are issued, and the safety factor of livable Nanjing is upgraded.

In order to strengthen the management of housing information release and provide convenient housing verification services, Nanjing Real Estate Bureau issued the Notice on Further Standardizing the Housing Verification and Information Release of Stocked Houses in the City, which will be implemented on February 1 2022. Carry out the housing verification work before the release of the city's stock houses (second-hand houses for sale and rental houses), standardize the information release, provide real housing verification for the people to buy and sell rental houses, reduce contradictions and disputes in housing transactions, promote safer and more transparent real estate transactions, standardize and orderly markets, earnestly safeguard the legitimate rights and interests of the people, and promote the stable and healthy development of the real estate market.

Housing release verification refers to that property owners, real estate brokers, housing rental enterprises (including individual industrial and commercial households) and online information release platforms within the administrative area of this Municipality should take the initiative to apply to the real estate department for housing verification before releasing information on the sale or rental of houses. The real estate department will verify the main body of housing release and housing ownership information through the Nanjing Housing Leasing Service Supervision Platform (hereinafter referred to as the "Municipal Service Supervision Platform") and give the housing verification code.

Where the house property owner entrusts a brokerage institution or leasing enterprise to release information on the sale and lease of second-hand houses, the brokerage institution or leasing enterprise shall examine the ownership certificate of the entrusted sale and lease house, the client's identity certificate and other related materials, and release the corresponding housing information only after obtaining the written entrustment of the client.

After obtaining the verification code of the listing, the subject of the listing release can release it through the "municipal service supervision platform" or other channels. The release of housing must clearly identify the housing verification code, and the ownership information of the same housing released through different channels should be consistent.

How to verify other types of houses?

The Notice on Further Standardizing the Verification and Information Release of Stocking Houses in the City will be officially implemented on February 1 2022. In order to bring different houses into the verification system, different verification methods are adopted for the following types of houses:

Failing to obtain the listing verification code before the issuance of the Notice:

Before the implementation of the document on February 1 day, 2022, real estate brokers, housing leasing companies and online information publishing platforms can apply to the real estate department for housing verification and display the verification code. Those who have not obtained the verification code after May 1 day, 2022, may not display it.

Rental housing without property right certificate but with proof of legal source:

■ Rental housing is mainly divided into decentralized and centralized types according to the mode of operation. Among them, decentralized rental housing generally refers to the residential housing in different buildings (such as houses, apartments, villas, dormitories, etc.) scattered in different lots. ). If the property right of the house is clear, but it lacks the autumn right number and the certificate number, the location information column should be filled in the format of "building number". District XX Road /XX Street ",at the same time upload the proof materials of the legal source of property rights and the photo of the public security two-dimensional code house number.

■ Centralized rental housing generally refers to the whole or relatively centralized house newly built, rebuilt and renovated by enterprises as rental housing. The leasing enterprise shall apply to the local real estate management department, and be included in the "municipal service supervision platform" management after being examined and confirmed by the relevant departments of the district.

According to the relevant requirements of the state, provinces and cities on the release of housing information, market entities and online information release platforms that sell or rent houses overseas should be responsible for the authenticity, compliance and effectiveness of their housing information. When publishing the information of selling or renting houses through operating shops, websites, APPs and other channels, it shall include the verification code of the house, the location, use, area, pictures, price and other contents of the house, and at the same time, it shall specify the information of the house publishing agency, shops, personnel and so on.

For those who fail to implement the regulations on the verification and release of housing, the real estate department will, in conjunction with relevant departments, take regulatory measures such as interviews, public exposure, removal of housing, and cancellation of online signing qualifications in accordance with the Cyber Security Law, the Measures for the Administration of Real Estate Brokers and other laws and regulations.

■ People's Republic of China (PRC) City Real Estate Management Law stipulates that the following real estates may not be transferred:

(a) the acquisition of land use rights by means of transfer does not meet the conditions stipulated in Article 39 of this Law;

(two) the judicial organs and administrative organs have ruled or decided to seal up or restrict the real estate rights in other forms according to law;

(four) other circumstances in which laws and regulations prohibit rental.

■ "Nanjing Housing Leasing Management Measures" stipulates that houses under any of the following circumstances shall not be rented:

(a) without obtaining the certificate of ownership of the house or other proof of legal sources;

(2) The ownership is disputed;

(three) * * there is a house without the written consent of other * * * people;

(4) being sealed up according to law;

(five) identified as dangerous houses can not continue to use;

(six) to change the purpose of the house, it must be approved by the relevant departments without approval;
