Regulations of Guangxi Beibu Gulf Economic Zone

(Adopted at the 13th meeting of the Standing Committee of the 11th People's Congress of Guangxi Zhuang Autonomous Region on October 24th, 20 10)

Article 1 These Regulations are formulated for the purpose of safeguarding and promoting the open development of Guangxi Beibu Gulf Economic Zone and accelerating the development of Guangxi Beibu Gulf Economic Zone.

Article 2 Guangxi Beibu Gulf Economic Zone approved by the state (hereinafter referred to as Beibu Gulf Economic Zone) includes the administrative regions under the jurisdiction of Nanning, Beihai, Qinzhou and Fangchenggang.

Yulin City and Chongzuo City participate in the functional group construction of Beibu Gulf Economic Zone planning, and their transportation and logistics are included in the overall development of Beibu Gulf Economic Zone.

Article 3 Beibu Gulf Economic Zone aims to build an important international regional economic cooperation zone with high openness, strong radiation capacity, economic prosperity, social harmony and good ecology and an important coastal economic growth zone in China, and accelerate the construction of China-ASEAN open cooperative logistics base, trade base, processing and manufacturing base and information exchange center.

Article 4 The autonomous region shall concentrate on accelerating the development of the Beibu Gulf Economic Zone, giving priority support in terms of policies, planning, projects, funds, technology and talents, and building the Beibu Gulf Economic Zone into a pioneering area for scientific development in Guangxi, an experimental area for reform and opening up, and a demonstration area for ecological civilization.

Article 5 The opening and development of Beibu Gulf Economic Zone shall follow the principles of people-oriented, scientific development, giving full play to advantages, open cooperation, scientific planning and ecological protection, and the principles of market orientation, intensive development, reform and innovation, and trying first.

Article 6 The Beibu Gulf Economic Zone implements a management system of unified planning, unified coordination, hierarchical management and division of responsibilities.

Article 7 The management organization of Beibu Gulf Economic Zone established by the people's government of the autonomous region shall exercise the management rights related to the development and construction of Beibu Gulf Economic Zone on behalf of the people's government of the autonomous region, and make and implement major issues such as overall development planning, major infrastructure construction, major industrial layout, functional zone development, relevant policy formulation, and development and utilization of shoreline resources.

The name and specific responsibilities of the management organization of Beibu Gulf Economic Zone shall be determined by the people's government of the autonomous region.

Article 8 The Beibu Gulf Economic Zone shall determine the industrial focus according to the overall functional orientation of the region and the carrying capacity of resources and environment. Encourage the use of the advantages of coastal ports, introduce large domestic and foreign enterprises, focus on the development of petrochemical, steel, forestry pulp and paper, shipbuilding, electronic information, grain and oil processing, new energy and other industries, cultivate and expand the industrial clusters near the port, and accelerate the formation of advanced manufacturing bases and modern logistics bases near the sea.

Article 9 Innovate the land use mode of Beibu Gulf Economic Zone, promote the reform of land use planning management system, implement the pilot reform of linking the increase and decrease of urban construction land, strengthen the economical and intensive use of land, and implement the reform of rural collective construction land circulation.

Strengthen the management and regulation of reclamation, explore a new mechanism linking the use of sea areas with land management, and rationally and orderly develop and utilize beach resources.

Article 10 The autonomous region shall give priority to the land for construction projects in Beibu Gulf Economic Zone, and the land for major construction projects shall be arranged by the autonomous region as a whole.

Eleventh to promote the construction of financial entities in the Beibu Gulf Economic Zone, vigorously develop the capital market, strive to improve the financial service system, constantly optimize the financial operating environment, and accelerate the formation of a regional financial center.

Encourage the establishment of new financial enterprises and financial service institutions; Support the establishment of Beibu Gulf industrial investment fund, venture capital fund and the issuance of municipal construction bonds and trust products according to law, and support qualified enterprises to go public for financing and issue bonds.

Twelfth autonomous regions set up special funds for the opening and development of Beibu Gulf Economic Zone to support infrastructure construction, key industrial parks and major industrial projects.

The special funds arranged by the financial budget of the relevant departments of the autonomous region should focus on supporting the Beibu Gulf Economic Zone.

Article 13 The Beibu Gulf Economic Zone shall innovate the talent development mechanism, formulate preferential policies for gathering all kinds of professionals, improve the talent public service system, optimize the talent development environment, and set up the personnel reform pilot zone in the Beibu Gulf Economic Zone.

Article 14 Beibu Gulf Economic Zone should vigorously develop modern logistics industry. The autonomous region focuses on supporting the construction of special customs supervision areas such as bonded port areas, comprehensive bonded areas, export processing zones and bonded logistics centers.

Article 15 The Beibu Gulf Economic Zone shall innovate the port management system, scientifically plan the port layout, comprehensively integrate the port functions, expand the scope of port opening to the outside world, optimize the port customs clearance environment, implement port information sharing, and coordinate all customs clearance ports in the economic zone to achieve linkage.

Article 16 Beibu Gulf Economic Zone will make use of the resources of international sister cities, international institutions, consular offices of foreign governments, overseas Chinese, compatriots from Hong Kong, Macao and Taiwan, etc. to expand international and domestic regional cooperation, expand the field of opening up, and promote economic, trade and cultural exchanges with ASEAN and other countries and regions.

Beibu Gulf Economic Zone will optimize the opening structure, innovate the cooperation mechanism, enhance the level of cooperation, standardize preferential policies for attracting investment and encourage orderly competition.

Seventeenth to speed up the Beibu Gulf Economic Zone ports, waterways, highways, railways, airports, energy, information, water conservancy, environmental protection and municipal infrastructure construction, improve the service and security functions.

Eighteenth to strengthen the Beibu Gulf Economic Zone education, science and technology, culture, health, urban and rural employment, social security and other social undertakings focused on improving people's livelihood, and constantly improve the level of public services.

Article 19 Beibu Gulf Economic Zone shall strengthen ecological construction and environmental protection, rationally develop and save resources, develop circular economy, promote clean production, and build an economic zone with prosperous economy, rich people, good ecology, comfort and livability.

New construction, expansion and reconstruction projects shall comply with environmental protection laws and regulations and meet environmental protection standards.

Article 20 The Beibu Gulf Economic Zone shall make overall plans for urban and rural planning, industrial development, infrastructure construction, public services, employment, social security and social management, carry out comprehensive reform of urban and rural planning, and promote coordinated economic and social development between urban and rural areas.

Article 21 The Beibu Gulf Economic Zone encourages and supports non-public enterprises and private capital to participate in the development and construction of the Beibu Gulf Economic Zone, relax market access and provide quality services.

Article 22 The people's governments at or above the county level in the Beibu Gulf Economic Zone shall establish an investment coordination mechanism to provide investors with investment policy consultation, investment procedures and investment dispute complaint services.

Article 23 On the premise of adhering to the principle of national legal unification, Beibu Gulf Economic Zone is encouraged to take the lead in reform in administration, finance, finance, investment and financing, land and foreign-related economy.

Article 24 Beibu Gulf Economic Zone should reform the administrative examination and approval methods, decentralize the administrative examination and approval authority, carry out the reform of relatively centralized administrative licensing rights, improve administrative efficiency, implement an open administrative licensing system, simplify procedures, shorten licensing time, and implement centralized licensing, parallel licensing and other licensing methods.

Strictly control the establishment of administrative fees according to law, promptly clean up and gradually reduce administrative fees and reduce administrative fees.

Article 25 The people's government of the autonomous region may formulate special policies and flexible measures within the scope of its functions and powers to speed up the development and construction of the Beibu Gulf Economic Zone without violating the principles of the Constitution and laws.

Article 26 The people's governments at or above the county level in the Beibu Gulf Economic Zone and the relevant departments of the autonomous region shall take practical measures to ensure the implementation of the policies and regulations of the state and the autonomous region on the open development of the Beibu Gulf Economic Zone, and adjust the overall planning and related special planning according to the development plan of Guangxi Beibu Gulf Economic Zone approved by the state. According to the functional orientation, spatial layout and development priorities determined in the plan, construction projects are selected and arranged to ensure the implementation of the development plan of Guangxi Beibu Gulf Economic Zone.

Twenty-seventh people's governments at or above the county level in the Beibu Gulf Economic Zone shall commend and reward the units and individuals that have made great achievements and outstanding contributions in the opening and development of the Beibu Gulf Economic Zone.

Article 28 The people's government of the autonomous region and the relevant competent departments shall strengthen the supervision and inspection of the implementation of the open development policy of the Beibu Gulf Economic Zone and the Guangxi Beibu Gulf Economic Zone Development Plan, establish an open development performance evaluation system, and establish and improve the reporting and complaint system; Units and individuals that fail to implement or improperly implement the Development Plan of Guangxi Beibu Gulf Economic Zone and other units and individuals that hinder open development shall be investigated for their responsibilities according to law.

Twenty-ninth in the opening and development of the Beibu Gulf Economic Zone, the reform and innovation, pioneering and testing have not achieved the expected results, but if the following conditions are met, the administrative responsibility of the relevant personnel may be reduced or exempted:

(a) decision-making and implementation procedures in accordance with the provisions;

(two) individuals and units did not seek personal gain;

(3) Failing to collude maliciously with other units or individuals and harming the public interests.

Where laws and administrative regulations provide otherwise, such provisions shall prevail.

Thirtieth these regulations shall come into force on March 6, 20 1 year.
