Article 2. Position and responsibilities of Party B:
1. From the date of signing this contract, Party B shall be responsible for the quality supervision of the construction project of Party A's Guodian Power Supply Station.
2. Be familiar with the engineering conditions, technical specifications and design drawings, control the construction progress and ensure the quality requirements.
3. Strictly implement the regulations of on-site supervision, check and sign every working procedure of the contractor according to the specifications, promptly put forward the non-conforming parts and ask the contractor to correct them. If major quality problems are found, report to Party A in time.
4. Supervise various tests of the contractor, including sampling, sample preparation, various standard tests and inspection tests. For any suspicious test results, a confirmation test should be carried out, and the contractor should be urged to sort out the test records and reports and file them in categories.
5. Conduct on-site verification and inspection of the bill of quantities submitted by the contractor on schedule.
6. Make supervision records and diaries, and report to Party A regularly and irregularly.
7, must strictly perform the supervision duties, and shall not take advantage of his position to engage in malpractices for personal gain, causing damage to Party A's interests. ..
8. Take full responsibility for personal and property safety during the contract period.

Article 5. Alteration, termination and rescission of the labor contract:
1. After the employment contract is signed according to law, both parties to the contract must fully perform their obligations stipulated in the contract, and neither party may change the contract without authorization. If it is really necessary to change the contract, both parties shall reach an agreement through consultation and change the contract according to the original signing procedure. If both parties can't reach an agreement, the original contract is still valid.
2. When the employment contract expires or the termination conditions agreed by both parties appear, the employment contract will be automatically terminated.
3. Party B fails to perform the labor contract.
4. Party B shall notify Party A in writing 30 days in advance if it wants to terminate the labor contract.

Article 5 Supervision fees and payment methods:
1, the project supervision fee shall be implemented according to the national and current market charging standards. Through negotiation between Party A and Party B, the supervision fee is calculated according to the project usable area 1 14 square meter, with RMB 8,208.00 yuan per square meter for 72 yuan and RMB 8,208.00 yuan for amount in words.
2. Within 3 days from the date of signing the contract, the entrusting party shall pay 30% of the total supervision fee of the supervisor, totaling RMB 2,460, which is RMB 2,460 in amount in words.
3. Within 3 days after the ceiling of this project is accepted and signed for confirmation, the client shall pay 50% of the total supervision fee of the supervisor, totaling 4 100 yuan, in words 4 1 100 yuan.
4. Within 65,438+00 days after the completion and acceptance of the project, the balance of supervision fees payable by the entrusting party to the supervisor is RMB 65,438+0,648, in words: RMB 16,480 only.
Article 6 Obligations of Supervisors
1. The supervisor shall dispatch the supervision personnel required for the supervision work according to the contract, and complete the supervision business within the scope of the supervision project agreed in the contract.
The supervisor decided to appoint Huang Lianxiong as the supervision engineer, and fully represent the supervisor to perform the supervisor's obligations stipulated in this contract.
2. When performing the obligations under this contract, the supervisor shall work diligently, provide corresponding suggestions to the client, and fairly safeguard the legitimate rights and interests of all parties.
3. The facilities and articles provided by the client used by the supervisor belong to the client's property. When the supervision work is completed or suspended, the facilities and remaining items shall be handed over to the client in the time and manner agreed in the contract.
Article 7 Obligations of the Client
1. The client shall pay the supervision fee to the supervisor in time within the time limit stipulated in this contract.
2. The client shall be responsible for coordinating all external relations of the project construction and providing external conditions for the supervision work. If part or all of the coordination work is entrusted to the supervisor as required, the entrusted work and corresponding remuneration shall be clearly defined in the supplementary agreement.
3. The client shall provide the project information related to this project to the supervisor free of charge within the time agreed by both parties.
4. The client shall make a written decision on all matters submitted to the supervision fee within the time agreed by both parties.
5. The client shall promptly notify the contractor of the selected contract in writing of the supervision rights and authority of the supervisor, and make it clear in the contract signed with the contractor.
Article 8 Rights of Supervisors
1. The supervisor shall enjoy the following rights within the scope of the project entrusted by the client:
(1), when the engineering design does not conform to the decoration quality standards promulgated by the state, the house safety regulations or the quality standards of the design contract, the supervisor has the right to report in writing to the client and ask the designer to correct it.
(2) Have the right to check the materials used in the project and the construction quality. Have the right to notify the contractor to stop using the materials that do not meet the design requirements, contract provisions and national standards, and have the right to notify the contractor to stop working, rectify and rework the processes, sub-projects and unsafe construction operations that do not meet the specifications and quality standards. The contractor can only resume work after receiving the notice from the supervision organization.
(3), the inspection and supervision of the project construction progress, and the actual completion date of the project in advance or beyond the completion period stipulated in the project construction contract.
(4) Within the scope of the project price agreed in the project construction contract, the employer will not pay the project payment without the signature of the supervision engineer.
Article 9 Customer's Rights
1. The client has the right to approve the change of engineering design cost.
2. The client has the right to ask the supervisor to submit the monthly supervision report and special report within the scope of supervision business.
3. The supervisor should get the consent of the client in advance to change the project supervision personnel.
4. When the client finds that the supervisor fails to perform the supervision duties according to the supervision contract, or colludes with the contractor to cause losses to the client or the project, the client has the right to ask the supervisor to replace the supervisor. Until the contract is terminated and the supervisor is required to bear corresponding responsibilities or joint and several liabilities.
Article 10 Responsibilities of Supervisors
During the supervision period, the supervisor shall perform the agreed obligations, and if the supervisor's fault causes economic losses to the client, he shall compensate the client. The total accumulated compensation shall not exceed the total supervision fee (excluding tax).
Article 11 The fault of a supervisor refers to:
1, the quality control was not strictly carried out in accordance with the national construction quality standards and construction specifications, resulting in the rework of the project.
2. The building materials were not strictly inspected as agreed in the contract, resulting in the rework of the project.
3. Failure to strictly carry out division and sub-item acceptance, make acceptance records, and confirm by the owner, leaving hidden engineering hazards and causing losses to the owner.
The basis for measuring whether the supervisor is at fault is the written report and project acceptance record given by the supervisor to the client or contractor.
4. If the supervisor neglects his duty during the supervision, he agrees to take responsibility and compensate for the losses according to the following methods.
Compensation = direct economic loss × 5% (reward ratio)
Article 12 Liability of the Client
1, the client shall perform the obligations stipulated in the supervision contract, and if there is any violation, it shall bear the liability for breach of contract and compensate the economic losses caused to the supervisor.
2. If a supervisor suffers losses due to reasons other than the supervisor when handling the entrusted affairs, he may claim compensation from the client.
3. The client shall pay the supervision fee to the supervisor within the time limit stipulated in the contract. If the payment is not made within the time limit, a penalty of RMB 100 yuan shall be paid to the supervisor for each day overdue.
Article 13 Entry into force, modification and termination of a contract
1. If the supervision work is hindered or delayed due to the reasons of the Employer or the Contractor, resulting in additional work or extension of the supervision period, both parties shall renegotiate the supervision fee.
2. When one party requests to change or terminate the contract, it shall notify the other party three days in advance. If the termination of the contract causes losses to one party, the responsible party shall be responsible for compensation except corruption. The notice or agreement to change or terminate the contract must be in writing. Before the agreement is reached, the original contract is still valid.
3. If the supervisor suspends the supervision business for reasons other than his own, the aftermath and resumption of the supervision business shall be regarded as extra work and entitled to extra remuneration.
4. Any dispute arising from the performance of this contract shall be settled by both parties through consultation. If negotiation fails, the following 1 method shall be adopted:
1, submitted to the Arbitration Commission for arbitration;
2. Bring a lawsuit to the people's court according to law.
5. For matters not covered in this contract, both parties can sign a supplementary agreement as an annex, which has the same effect as this contract.
